Upon spray painting the "bad spots" on my tiller, the "bad spots" was a very poor way of shipping and stacking tillers by First Choice, anyway I've found out that First Choice had AWFUL paint jobs... Horrible... Sad. Sad. Sad.

One of the things advertise is "chip proof paint". There's no truth to this.. It chips and flakes off. I have HUGE flakes all over the tiller. Huge, I have several spots bigger than a quarter, one spot the size of a grapefruit. I didn't go over the whole unit but there is an issue with First Choice paint jobs.

The tiller has been a workhorse, but not worked that much. 3 or 4 years old and I till the garden in the spring (about 1/2 acre) and then again in the fall. Two years the tiller stayed in the dry thru the winter. Another year covered by a tarp.

I have a Fred Crain rotary cutter thats about the same age and it spent a year inside thru the winter, the rest outside. I've used it many, many, many hours in pretty rough conditions. There's plenty of scratches but no flaking paint, now chipped paint.

Now, I will reconsider buying First Choice implements for this one reason.

Boman, I think after you brought this issue to thier attention, First Choice addressed and corrected that problem some years ago. I will make a 1 time offer, good for 30 days. If you will deliver your unit to me, I will exchange it for a new one at no cost to you. This should remedy your problem.--If you decide to take me up on this offer, Call 270-528-3323 or email: sweet@scrtc.com in advance to be sure that I have them in stock.-- Ken Sweet

If anyone is even slighly interested in how this old story was played out years ago, here is the link to it. I am sure that most if not all, thought that this was over and done with. First Chose changed their procedure for future for all future products.

Ken,
There are legal ramifications of you making this a public offer as you just did. Exchange of problem implements with customers happens among manufacturers as a matter of good will and state lemon laws. Most any respectable dealer will do this in private to satisfy a customer. By you publicly offering to replace the tiller for "thebowman", you may be legally obligated to offer this transaction to any and all of the customers you have sold First Choice tillers too that have this problem. Because the laws vary from state to state, this is a contingent liability that is open ended. The big question for Sweet Tractors is do you have to indemnify each customer in the same manner?
Since you are neither the manufacturer nor the distributor you are not legally speaking for them and have not obligated Sicma or First Choice to this Sweet Tractors "Recall" of First Choice tillers for rust problems. If another one of your customer demands this same offer, you almost have to do it. If not ,you are saying to them that the "thebowman" is more important than them. You may be obligated even if "thebowman" does not take the offer because you made your offer in a public recall manner.
You have also put Buy Smart-First Choice and Sicma in a position that they now will not publicly help Sweet Tractors and take care of these tillers problems. They likely have long ago chosen not to obligate themselves by a recall and have dealt with each situation in a private manner. You have painted yourself into a corner legally. Will this be known as the "Sweet Tractors Recall" case?

Well said, Mark. Maybe Ken will have this deleted. Sometimes, good faith can get you into trouble. /forums/images/graemlins/frown.gif

I am floored with Ken's offer, Ken is straight up and honest with his customers. In fact I have no intentions of having Ken swap out the tiller, but if First Choice made the offer I'd more than likely trade it out (depending oh where I have to deliver mine too).

A couple years ago when I brought up the paint, there were only two areas. Now bubbles flaking paint is happening in many places, and many places that don't have dirt flying on it, or gets jarred around by hooking up etc.

Thank you Ken for the offer, but I don't want to put you in a pickle of a situation since it's a First Choice problem, you have done EVERYTHING possible. First Choice on the other hand sent a decal and a can of spray paint.

You want a great deal and customer service, check out Sweet Tractors and Ken Sweet. I have a great deal of respect for him and his business.

Mr. Sweet,

Nice to know somebody still stands by the products they sell.

I will strongly consider your company for my next implement purchase. Previously, I would not have considered buying from a distant company (sight unseen).

Hats off to you sir.

I've got one item ordered from him, and I'm looking at another. I'll be doing a LOT of business with Sweet Farm Equipment from now on.

A CLASS ACT, WITHOUT A DOUBT!
