    Default Sales tax question

    Cant find a real answer i understand so maybe one of you can help. I bought a tractor/implements and trailer in Texas (brand new) i live in louisiana. I bought it all sales tax free, do i owe sales tax here in Louisiana now? To get the trailer registered here ill have to pay sales tax at the dmv i read. But as far as the tractor/implements do i have to pay them? And if so who do i contact to pay it to?

    If you purchased goods from out-of-state companies for use in Louisiana and were not properly charged Louisiana state sales tax, Louisiana Revised Statute 47:302(K) requires you to pay a Consumer Use Tax directly to the Louisiana Department of Revenue.

    Yea i found that news story which is why im trying to find this out. I got the texas ag/timber tax exemption for it all but just trying to make sure its all legit so later on i wont be penalized.

    Call your Parish taxing authority and ask. If you happen to live in one of the Parish's mentioned, you have some names to start with.

    The story mentions that, as long as the tax was paid the penalties would be forgiven, so I don't think the people would be that difficult to deal with.

    Although the law says you owe sales tax, the reality is that gazillions of people purchase goods from another state every day and don't pay their states the sales tax the law says they are required to. So, the two questions each us answers in that situation are 1) does my conscience allows me to avoid the tax I'm legally obligated to pay, and 2) am I willing to take the risk that my state will find out and come after me.
    I presume some states are more aggressiove than others in tracking down those folks owing sales tax. I sense that my state (Kansas) is not one of the more aggressive ones although I did pay sales tax even though I purchased my Kioti out of state. I did so only because I couldn't comfortably answer "yes" to both of the previous two question. I also assume states would go after a $30K sales more aggressively than a $20 online sale.
    I would guess tens of thousands of folks have purchased a new tractor from out of state, opted not to pay their sales tax, yet have lived uneffected since then. To each his own.

    Yea im all for not paying taxes if i dont have to of course, but i dont want to be into the 4th year of paying it then owe thousands bc i said whatever and tried to get away with it. If i owe them id rather pay now and avoid troubles later. If others have avoided it then thats them, right is right and wrong is wrong in my head though. So yea im calling around my parish trying to find the right person to answer my question.
    Figured someone else has been in my state buying from texas to give me the definitive answer

    Don't ever ask someone from the government. Federal, state or local level. I can guarantee they are going to say to pay them when in fact you might not be legally required to. Ask a tax preparer or tax lawyer.

    If you took a secured loan to finance your purchase, the lender will record the UCC form with the county listed on your loan application. The tax folks in many jurisdictions check for UCC forms registered from out-of-state dealers, so the likelihood is that they will bill you sooner or later. I would consult a sales and use tax specialist to go over the ins and outs of the law with you to determine your tax liability. For instance, some jurisdictions charge lower tax rates or do not tax agricultural equipment used for farming.
