Tort cases and awards have three players, Plaintiff, Lawyer and the most important the Juror.

Did you forget the 4th player; the judge who decides what evidence he/she will admit and probably for the most part has decided who will win before the trial starts?

While were at it, lets ban soup from school lest some kid " suffers and will suffer personal and bodily injuries, pain, humiliation, embarrassment, worry, permanent disability, health care expenses and other economic losses," from spilling some soup on her.

Clearly, we as concerned citizens must return to serving cold gruel these children. It's in their best interests :rolleyes:

Schools seems to be the choice of people suing today. Look at this one where a teacher was awarded $680.000.00. I personally think he sued the wrong people. I think he should have sued the people who made the false claims. Teacher forced to resign over false 'improper touching' accusations gets $680,000 - U.S. News

Most of the time in a Tort case the Judge is not forced into the role of a referee as much as in a criminal case.

IMHO he should not only have sued the school and HR like he did, but the parents and kids who lied as well. The school should have investigated and found there was no wrongdoing and dismissed the HR person immediately, for that they are partly responsible for his loss of reputation. He'll never really be able to work in his profession again, even if all reference to this is removed from his record, his name is still "tainted".

Part of the problem is these kids and parents get to hide behind anonymity and ruin this guys name while there is no consequences for their actions. If the accused is found innocent in any of these type cases from rape to mere "inappropriate" touching, the names of the accusers MUST be published.

There are many women out there who are repeat false rape accusers who never suffer public scrutiny while the man has his name in the paper (and consequently his reputation ruined) even before the first trial date.

I agree that in jury trials, the jury has the final word . Except, some innocent defendent may still have to spend a fortune on legal fees to defend himself. And one , or both, sleezeball lawyers will misrepresent the facts and mislead the jury with nearly every sentence they utter. And some ex-lawyer wearing a black robe will control the trial to the extent that it leads the jury directly to one decision or another . Worse yet are family court divorce and property settlement proceedings, where there is no jury at all , and no courtroom witnesses. Then, the judge makes all of the decisions , based on a pre-conceived bias for one party. And a lot of us found out the hard way who wins those cases, didn't we ?

But I do think we should center the blame on the people making the rules, not the ones following them.

The problem is that the vast majority of legislators are lawyers and they purposely write the laws in such a way to benefit their own kind. Personally I'd like to see lawyers be banned from being legislators, and their only role in the legislative process would be to serve as an advisor to the legislator. If a lawyer wants to be a legislator; they have to surrender their bar card during the campaign, and if they win the election, they surrender their license for the term they serve plus five years. Some may say this discriminates against a profession, and yes it does; but the legal profession has proven they can't be trusted to craft laws that benefit the citizens first and their brethren second.
