I'll keep you posted on any updates. Nowadays if you want to buy land in Texas, its not going to come with mineral rights.

My brother has been looking to buy land in central Texas and every piece had some minerals from 1/8 to 1/2. I also know a Texas TBN member who sold estate land with some minerals attached this last year. That is a myth that the mineral right owners have put out and it is working.

VP, don't believe for a second that the price is not negotiable, especially if this is from an independent landman working on contract for the oil co. Tell them you want $10,000 per acre and you want it fenced off and four rows of trees planted next to the perimeter to shield the noise and view. Add in all kinds of protections like their interest terminates after 24 months of continuous non-production, cleanup, removal of equipment etc. Limit the site to one and only one well and no facilities other than required for that well.

Thanks guys, I sure appreciate the advice. Sadly the mineral lease was done long before I acquired the property. I'm working hard on a surface use agreement that spells out a lot of the things you guys mentioned. Its much harder to get them to sign this agreement after the fact (the mineral lease being completed). I am dealing with a contract landman and if we can't come to terms, I'll ask to talk to the inside landman, maybe I'll get better level of attention.

I like the idea of trees around the pad site. Hadn't thought of that.

if they can come and do anything they want, then why is the Landman coming to see you?? The Landman coming with his "we don't negotiate" story tells me you have more say than you think you have. I follow gomarcellusshale.com, where these things are discussed in detail.

At least get an attorney that specializes in oil and gas, and normally works for landowners.

VPracer, it sounds like you are trying to negotiate this yourself. You're not a lawyer are you? Get a lawyer! You need a lawyer. A lot of us here are TBN like to consider ourselves renaissance men who are experts at a little bit of everything. But in this case, there is no shame in going with a real expert. Would you try and perform open heart surgery on yourself to save a couple bucks? The land man makes his money by stonewalling land owners and putting the fear of losing anything they could possibly gain by waiting. I recently dealt with a pipeline company about putting a pipeline across our land. The land man did everything he could to try and sabotage. And if you talk to a lawyer who tells you a bleak tale, talk to a different lawyer. These companies will do some very shady stuff, like buy local lawyers so they will start singing the "yeah you don't have any recourse, you should sign" song. In the end, the only difference might be looking back and having no regrets, and knowing you did everything you could. Or looking back and thinking "dang, I shouldn't have signed so easy". My two cents, :2cents:good luck to you. I would put you in touch with my lawyer, but they don't operate in Texas.

Tell them you also want to keep the water well when they are done. Use it to fill the pond or set cattle tanks by it.
