Well in the town i grew up in my father and i are constructing an equine trail center, On our own 365 acres mind you. well aparently the zonig board comprised of people who moved to the town from other places bought large tracts of rundown properties, demolished existing homes barn etc build gigantic dream homes and facilities and then enacted strict permits and zoning for people do do the same. its a crazy world we live in now I guess we are running into Strong oposition for creating an agribusiness in a place where an agribusiness ( a dairy farm already existed for over 100 years. On our own land mind you. anyone else find these kinds of problems with their own land? I am trying to keep this out of the legal system hands. any tips? /forums/images/graemlins/confused.gif

ah yup ... http://www.proprights.org/king_cao.htm

"One of the many new regulations contained in these new ordinances is a clearing limit for unimproved properties zoned RA. The limits are 50% up to and including 5-acre parcels. Parcels larger than 5 acres can clear 2.5 acres or 35%, which ever is larger. The remaining 50% to 65% of your land will be restricted to growing native vegetation. No mowing, no pastures, no gardens, and no orchards."

Unfortunately I think you are right. Anytime the activists get involved you can count on needing a lawyer. And you are correct, it's an insane world we live in.

Keep an eye on Wyoming. It's going to get bad, even more so than it already has, there. I've heard tale it's one of the fastest growing sates in the nation. (anyone know if that's true?) All the baby boomers are wanting to retire to the "wild west". I've heard some pretty ridiculous stories about it already. They say they are going there to escape all the rules and crap they put up with for 30+ years in the "civilized" east. Funny thing is, they are beginning to establish the same stupid rules and ordinances (especially zoning from what I here) they allegedly are trying to escape and it's not going over very well with locals who have lived there for generations.

It doesn't matter that you own the land. In their mind, we are only stewards and as such we should make decisions as a community. Sounds pretty socilistic or communist to me!

The town I just moved close to (Carrollton) I guess they tried to pass zoning ordinances that affected homes up to 1.5 miles OUTSIDE the village limits! It failed. I can't believe the power grab even local governments are pulling off lately. Scary as He!! as far as I am concerned. I might not be able to pass my land on to my children but instead they might be forced to "share" it with the community.

Yeah thats the angle they want us to pay 12 k a year in taxes and just allow it to be disney land for anyone who walks onto it. very frustrating . The equip is idle until we find out the scope of the quagmire /forums/images/graemlins/frown.gif

Have you been to any of the Zoning Board meetings? Even an informal discussion can sometimes get you some impressions from the board--and maybe even guidance as to what is currently allowed. If what you want to do isn't in the regulations--you can always ask or apply for a variance--and maybe based on the past useage you get get one granted. I know that on our boards we have to follow the laws/ordinances, but we usually welcome discussions before a formal application is made.

The land is in NH . The farm has been in our family for a long time and we thought this venture would keep it that way profitably

You certainly have plenty of land, so it must be permitted use that is creating the issue?? What uses is it zoned for??
Perhaps this is a continuance of the farm business that was there?? or is it common knowledge that the previous farm had ceased business?
