Yep.... There have been countless thousands of contracts voided by courts. No telling how many lawsuits filed even when all parties are SURE they've dotted all the "I's" and crossed all the "T's". And just as in my case this time, even though I didn't see where the guy had a leg to stand on, I STILL had to drag out the attorney, take time off work, and go deal with what I'd consider a frivolous lawsuit. (that has since been dropped)

I've got contract forms, statements of insurance coverage, detailed explainations of "scope of work", and any other precaution I can take, all signed before work begins. I still keep my attorney's phone # handy.

You've been lucky......No contract, no disclaimer, no written or verbal agreement can eliminate you entirely from liability if the other party can prove negligence in any shape or form. Paper has a way of discouraging lawsuits, but not preventing them entirely. That's why the general contractor I work for has a staff of lawyers on retainer.

It's not just luck. Things are also less litigious up here. Canadians just don't sue as often. Sadly, that's changing, but it's still much less common in Canada than the US.

There's also the matter of me being willing to fix things that are my fault. Hey, if I trench somebody's lawn by driving on it when wet, or damage somebody's property when backing a trailer in, I should pay to fix it. Things happen sometimes. I fix the little things out of pocket and make insurance claims for the big ones. It doesn't happen often, but it does happen.

The frivolous things like the driveway and the lawn watering system...well, the people generally know those things are frivolous when they start out, so they aren't willing to put up much of a fight.

I didn't see anywhere in previous pages where people wer not willing to fix legitimate damage.

and since the discussion / issue is based in the us.. then it's VERY relevant as to location, vs the 'sue' issue. Makes little sense to interject that your contract protects you fine in lower uganda since they have no legal system there and there aren't many lawsuits.. when the issue being discussed is in a place that does have an active civil system...

I am glad that this issue ended at the table like that, but it makes me wonder how many people you come across with an ulterior motive?

Not jacking this thread, but last winter a guy who works at a feed mill asked why we did not put a snow plow on my truck, to make some extra cash. I simply told him that I do not plow something that I could not see and photograph in the fall, and again the following spring. He asked why, I told him we would not be paying for damage we did not create. I also do not do driveways, maybe small factory, but that is it. Am I paranoid to want to do that?

Yu just have to remember, that this forum is viewed worldwide, and that there are regional differences in practices and customs.

no one had a problem with his post.. he just chose to act like someone did.

his comments about it not being a sue happy place where he lived had little bearing on the sue happy place that the events we are posting about, occured.. and i pointed that out.. he then chose to decide that the comment meant that this was an 'america' only forum.. which i pointed out it had no such limitation. Classic mountain from a molehill issue...
