When I bought my 6.5 acres a few years ago, the farmer was selling off part of his farm in small plots. He can only sell so many plots of such size every so many years. My lot borders the main road. When we made an offer, he came back and said an acre down the side of my lot would be an easement to get to his remaining 32 acres. He agreed to our price and we accepted the easement. They had it wrote into the deed of the land. I was concerned that he may sell the remaining 32 acres to a developer so checked with a lawyer. The lawyer said it depends how the easement is written into the deed. He said if it was written as a farmer to access his field then they could not put a road in on the easement but rather have passage to the property such as with farm tractor and large trucks. I also asked if they could hardtop that area and he said not without my persmission because it was still my land and the easement was just allowing him to cross my land to get to his land.
