Sunday, my boy and I were walking over to the pond to do some fishing. All of the sudden the ground gave way and I fell up to my waist in this!

I grabbed a shovel and opened it up some more.....

My wife thought that this might have been our ticket to retirement (gold mine, treasure, etc.) I was thinking, "How much is this going to cost?".

I called the Ohio Department of "we really don't care cause it will cost us money." You guys can see were this post is heading!

Being Sunday, I caved in the sides with the backhoe simply to cover the opening at both the ground level and at the bottom of the hole on either side. Had my boy, wife, neighbor, or dog, fell in I would have had a major problem. The guy said that since I eliminated the immediate danger, I should call if it opens back up and they will "look" at it again. I'm expecting a complete written report from the state in the mail within the next several days and perhaps there will be more information contained than what I have experienced already. While talking to the man and reading between the lines, he more or less stated that there was mining activity in the vicinity and that this "may or may not" be related to it.

I took my little NH TC24DA with the BH on and caved in the sides enough to cover things up to be safe. Here is what I'm left to deal with.

It's already sank some since Sunday and who knows if the garage is going to dissapear! I don't feel safe around that area now.

Time for an attorney or should I give ODNR more chances? Ah....the government. Hope and change is here! :)

I guess I'm a bit dense, but why call anyone? Why would the gov care if you have a hole in your yard, and who would the lawyer be going after?

Are there any mines around you, deep or shallow? Check to see who has mineral rights under you, if you don't. It may be a place to start. I'd be very concerned if it were my property.

Your home owners insurance may come into play. See if you are covered by mining damage. I remember our agent discussing this with us.

Mega, I saw your reference to this problem in the safety forum and saw you live in Muskingum county. Mine subsidence insurance is mandatory in Muskingum county and will pay for damage to your dwelling. I am not sure if out buildings are covered. Your home owner insurance provider should be able to tell you about it. Here is a link to more info. OMSI - Eligibility

I would not go any where near that spot with a tractor .
It could have opened up and swollowed up the tractor and him rite along with it.
