Sorry about being so long winded but a lot has happened in the last week. We closed on the 19.5 acres on April 29. I have been clearing the fields and for the most part everything has been quiet. At least it was until last Sunday.

The land was part of an estate that was surveyed & divided into 4 tracts & each heir took one tract. I bought the tract that joins our house property. The couple that we bought the land from are not related to the other 3 heirs. The other 3 heirs have been a problem since the first time I saw them. Knowing this I went ahead & posted the land & put up long pieces of orange surveyor tape at the signs so that they would not have any excuse for being on the property.

It took until 6/2/13 before the other 3 heirs realized the land had sold. So last Sunday while I was bush hogging they came over to the property with a group of about 8-10 people to go 4 wheeling om ATVs. They were on their property & when they came to the property line where I had put up the No Trespassing signs they stopped & pulled up the t-post with the no trespassing sign & wadded the aluminum sign up, took everything to over my house & threw it across the yard.

My wife went to see what was going on & one of them ran up against her with a 4 wheeler & was pushing her with it telling her to get off of the property because she had no business there. She told them we had bought it & for them to leave. They just laughed & said they would do whatever they wanted to & there was nothing she could do about it. My wife called the police & one of the neighbors saw what was happening & called my parents house. My Mom came to where I was bush hogging & told me so I went to see what was going on.

When I get there 3 of them had left & there was still 6-7 more there & they are all cussing & screaming at my wife & daughter. I ask my wife what's going on. She starts to tell me & they are still screaming & cussing. I told her to call the police & she said they are on their way. When the police finally get there they have gone back to their side of the property line. They tell the police that THEY OWN the property & that I won't let them on their property. I showed the police my deed, the survey plat & the survey marker next to the road. They said it doesn't mean anything to them & that it is a civil dispute because we both claim to own the land.

They tell the police they have a surveyor that will be there Monday morning to prove that they own the property. The officer tells me that he really can't do anything because they claim to own the property & they have already hired a surveyor. So finally they all leave & police talk to me while I am putting up more posts & signs then leave.

Fast forward about 2.5 hrs. & 2 of them come back (1 guy & his GF). They are tearing down the new posts & signs when I walk outside & see them. I tell them to get off the property again & the one that pulled up the t-posts starts toward me with 2 of them over his shoulder. As he gets about 20 feet from me he throws them in my direction & starts toward me with his fists doubled. I called the police again while he's cussing me & telling me what he's going to do. I hang up & tell him the police are on their way. He then starts walking toward my house & I'm still telling him to leave & get off my property. I got in front of him still telling him to leave so he starts pushing me trying to get past & I push back until he decides he's not going around me. While this is going on his GF is on the phone & about 5 minutes later an SUV with 5-6 more people show up. They park in the road & are climbing through the fence & start to swarm around me. They are cussing & a couple of them are in my face & pushing me. This went on for about another 10 minutes & one of them starts yelling we need to leave because the police are on their way. They all load up one grabbed my t-posts & signs put them in the SUV & take off. About 2-3 minutes later the police show up, I tell them they are gone & they ask what they are driving so I told him & he takes off after them. Turns out he had just passed them about 1/2 mile down the road & had back up on the way & they were able to catch them. I waited over an hour before he came back & then he tells me the same thing this is a civil matter you need to settle it in court instead of calling us.

Their surveyor never showed up so I called him to ask when he would be there. He said that he told them that the property corner was correct. They said they aren't & they want them moved. He told them that if they wanted him to do any more work they would have to pay for it. SO they tell him that he didn't finish the job & he needs to put markers on the line so they can see it. Again he said he told them he had done the job that they paid for & if they want more they will need to pay for it. They cussed him out & hung up.

I have talked to a couple of attorneys about what I need to do to keep them off my property & they said to file a civil trespass lawsuit. This would allow the judge to rule & then if they come back on the property they could be charged with contempt of court for violating a court order. The only thing is they expect it to take 12-18 months to go through the court system & cost $8-10,000 or more depending on how hard they fight it.

I have also been told by a mutual acquaintance that when the police stopped them the GF that came back the 2nd time had a bag of pot in her possession but they let her go because she was 2 months away from being 18????

If someone is pushing your wife with an ATV that's assault. If someone pushes you that's assault. I'd call someone competent in the local PD and file charges. Actually, in most jurisdictions, if someone approaches you in a threatening manner it's considered assault. If they touch you it's assault and battery.

If you own the land then you own the land. Be sure of that. It's not a civil dispute. And as far as lawyers go if they can get $8-$10,000 out of you they will do so. It is trespassing. It is that simple.

Wow, what a bunch of rednecks, not the good kind either! Sounds like they are just a bunch of kids?

I can't believe the police wouldn't do anything about them destroying your signs.

When dealing with people like this, you should first read The Gift of Fear, by Gavin De Becker. Someone here on TBN recommended it a while back, and it is a must read for your own safety. Plus, he gives you some do's and don'ts that are not necessarily intuitive. Trust me, you will be much better equipped to deal with these folks after reading it.

If it is a civil manner go to a magistrate and press charges for trespass. I'm not familiar with laws in other states but in NC if someone is trespassing and you ask them to leave and they don't it is first degree trespass. I agree that touching, pushing, threatening and contact by a four wheeler is assault. That is NOT a civil matter it is criminal.

In Ohio if you call the police or sheriff and tell them that someone is trespassing they will come out and take care of the trespassers. They aren't concerned about a deed. The dispute over the deed would be the civil matter as far as the police or sheriff are concerned.

Agree with the others. The threatening and trespass are criminal complaints. The property dispute would be civil. Based on how you described it. I would venture it generally the same in every state.

You should file a complaint on the officer(s) also, they clearly didn't do there duty (based on what you said). You may want to talk to your Prosecuter in that jurisdiction.

The 1st call the Sheriff's department responded &the 2nd call the State Police responded. Basically the same result. I would have thought the SP would have done more.

Lazy law enforcement. Assault has varying degrees from physical to verbal. Damage to property is a crime. So is criminal trespass. This means coming on to your property to commit a crime. e.g. property damage, physical confrontation to verbal abuse and a bunch of other crimes they committed. Lets throw in Menacing also.

In Oregon you don't go to court to determine who committed a crime on someones property. Someones going to jail or recieve a ticket when physical damage is done to property or individual.

If you are living in a house legally purchased and someone came to your door and came and caused trouble are the police going to ask you for the title of the property. No they will ask the person living there for ID (which usually has the address) and someone will go to jail. Simplified of course but residence and immediate posession usually takes precedence over someone with no proof in hand saying it is theirs.

When people enter your property, push, shove, threaten and intimidate, that is not a civil dispute. It sounds like the local police are not willing or are afraid to enforce the laws. For whatever reason, your neighbors have no fear of breaking the law, or of any consequences from their actions.

I would begin by speaking with the Sheriff or Chief of Police in your area, explain the situation and say you are there to file charges, now. If they blow you off, file a complaint with the State Attorney General. You need to build a paper record of attempting to get the police to do their jobs, and that documents these occurrences.

And the 3rd call to the local media. Sheriffs don't like negative publicity. In SC you have to give notice of trespassing. The signs you put up is the notice. The police should have locked them up for trespassing, assault and battery at the least. Don't know about Kentucky, but SC if you feel your life or wife's life in danger, then I would at least get and carry a gun on the property. They seem mighty bold, wouldn't trust them at all. Are you from this area?

Can you hire a surveyor to post pins on the line so there is no misunderstanding? You definitely need to record every interaction u have with these people. I have a friend who has spent thousands in court just trying to use his right of way over a period of 10 years or so. U need to make sure you get a good lawyer who will go for the jugular quick and get things done. If those folks just want to keep on harrassing you chances are they will get away with It for awhile while the justice system runs its course. Too bad u just cant shoot them all and bury them on your new land. Sounds like they wouldn't be much of a loss to society anyway.

In MD any physical contact whether a four wheeler or a part of a persons body touching another is assault. Legally trespassing is either by way of posted property or being on the property after being told not to by the owner. That being said, they are both misdemeanors and if they did not occur in the police officers presence then the police cannot charge them. The victim would have to do that by going to court.

As far as the trespassing is concerned in court it could go either way. They could say, well you have documents saying the land is yours so therefore trespass did occur. If somehow the other party shows the property is there's from another surveyor or lie saying they weren't on the property then nothing would get done.

In MD the trespassing would be a civil issue if the police arrived. Surveyor or not. It would be up to the courts. No paper is honored unless signed by a judge in a civil matter.

Two different surveyors can have two different property lines (I had that problem when I had a survey done). Not to say that is your case. I believe you are just dealing with misfits. But that is why police here say its a civil matter.

My suggestion would be to file a civil complaint so it can be settled by a judge. If the police are called again at least you can show it has been settled in court.

No easy way. I am using the mobile app and it does not show your location. Every state is different.

I have a friend who has spent thousands in court just trying to use his right of way over a period of 10 years or so. U need to make sure you get a good lawyer who will go for the jugular quick and get things done. If those folks just want to keep on harrassing you chances are they will get away with It for awhile while the justice system runs its course. Too bad u just cant shoot them all and bury them on your new land. Sounds like they wouldn't be much of a loss to society anyway.

I am working on getting someone to survey & mark the line every 100ft so that I can put up a fence. I bought this to put cattle on to pasture.

It could be the "Good Ole Boy" situation also. The trespassers know the police or they know or are related to someone in the local court system or government. I got tangled up with that once.

These people don't live on the property next to mine. They live about 8-10 mile away in another county & use this for a party place. This is on a dead end road & I am at the end. It is 7 miles to the nearest town. When you call the police it is usually at least 30 minutes before anyone shows up. They know this & try to get out before they show up. I had a situation where they stole the gate off of my other place & it took almost a month to get anything done. The county attorney sent them a letter telling them to stop trespassing.
