Hi all,

Those of you who live on private/shared roads, how is it working? I live on a 1.3 mile long private road and we are at the end. Basically, as the large tract was divided, we all received an easement to access our property. The easement is a generous 50' wide swath. It is my understanding like most rural settings, we all own to the middle of the road.

It is a gravel one lane road. We have no home owners association, just chip in each year to have it graded each year. Some years, I fill chuck holes and we have been able to skip the annual grading. During big snows I grade for snow.

Last year, we had one of the folks up front build a speed bump. From what I have heard, it's few supporters, a few keep their opinion neutral and many opposers. The word is; the speed bumps are to slow people down because of the kids. The real reason is the dust. The guy who built it has a 6' tall stockade fence.

I have removed the bump with my tractor with the help of one of the opposers. It gets built back up with hours. (note I live 1 mile tractor ride away, 2 mi round trip) Another opposer was a bit more aggressive, just drives around the speed bump, through the builders yard. Getting on the gas a bit while doing it. Other folks who claim to be neutral, have found lumber at the edge of the road with many nails pointing up!

To me this is all very ridiculous. Last weekend, they saw the fellow drive around the speed bump, into their yard and they called the county sheriff. The sheriff drove the the fellow's house to address the yard job. He explain to the sheriff that if this guy keeps building speed bumps, he just going to use the smooth part of the easement, his yard.

It would make sense that we organize a formal HOA for the road. Elect a president and vote on such issues. We all informally agreed to drive 20 mph a few years back. But clearly the speed bump is large enough to require to slow to about 5mph

As a good neighbor, I try to drive slower when it's dusty. But if it's mid day and wet I do drive faster. Other neighbors do have a tendency to drive pretty fast. He happens to be one of the first ones out there.

How is it working....

Well, in hindsight I wish we had not brought in a "partner" to buy our parcels. If we had just gone on our own, we would be much happier though with a bit more debt that will only take a couple years extra to pay off. :rolleyes:

Same arrangement here. One of the dust objectors paved in front of his property. Another put in larger gravel without much dust in it. Looks like about 1 1/4 crushed without finer material in it. I don't fix potholes and washboard as much as I used to do.

I live in a medium size development with private roads. When the roads are good, many drive way too fast which causes lots of dust & rough roads. When the roads are rough lots of folks complain.

Anybody asked the folks why they have the bump up - not hearsay but sat down and asked them?
Maybe then you can find a compromise.

We had something similar, bumps never got put in but we did agree to road signs with a posted limit and for "Children At Play" signs.

We also as a group went down and talked to the parents of the worst two offenders for speeding. One was a teenage girl all we had to do was ask them once and she quit and never sped again. The other was an probably 30 year old that lived with his parents and we had to finally convince him that if he hit one of the kids he better dial 911 and go turn himself in at the jail before we could catch him.

Overall we avoided having the speed bump and with folks listening to each other a little better kept the whole neighborhood safer.

If you all used to chip in to get it graded what about chipping in to get it sprayed for dust control? (assuming that really is the issue and not speed).

It may be different state to state, but here in VT, an easment is just that. The right to use the property of another for NORMAL access to your own property.

You DO NOT OWN the roadway at all. But, you may be responsible for it's maintainance. Read the terms of your easement. Talk to the rightful property owner. The road is surely attached and described as part of one of the properties in your area. IF the road is owned by the fellow building the bump, you just need to live with it.

Find out the FACTS. guessing is a waste of time.

What's with the "Children at play" signs on a road? I don't get that. I thought roads were made for transportation?
Don't parents teach their kids anymore, to play in their yards, or in the fields or woods? What parents let their kids play in the street, then complain of a motor vehicle?

Ever seen a kid chasing a ball? Or playing tag? Or crossing the street to get the mail?
Kid is running to catch a fly ball?
We don't let them play on the "road" - which in my case is a ONE lane dead end private road - we have it posted at 20mph, it works for us.

The people who drive 60 we have a problem with.
