Neighbor has elected to damage over 20 trees

Ohhhh..... This will really be interesting when we find out the assessment to rebuild the road in the ROW.

The thought entered our minds !! To relocate the road to its proper place would mean the neighbor loses a bunch of land ! Right now the entire current road that runs along our property is on our property. Going to let sleeping dogs lay...!!

Not really, the neighbor did not do the original survey and I would say he has the reasonable right to the roadway ROW as it was when he bought since no one informed him otherwise. But as 747driver says, best let sleeping dogs lie. For a few feet why get into an expensive legal peeing contest.

Now that you have your survey done, one thing I would do, is to mark your property line and the edge of the right-of-way with t-posts driven in deep and a piece of PVC pipe over the top to make them easier to find. I would put them just inside your property line and right on the edge of the right-of-way (where it's convenient to do so). That way once the flagging tape deteriorates and falls off, there is no question as to where the line is.

I've pounded survey rods into the ground leaving a few inches. Then frame it with 2x4, and put a concrete pad around it. That way mowing etc won't knock them down.

Thats what we have done with our other property for markers. The pvc over the T post really stands out. Thanks !

I might try this method. Usually get some 4" pvc and put in the ground then fill with concrete. Thanks

Yes... and he could have conversed with his neighbors before undertaking his land clearing.
