Tractor
Mitsubishi 180D, Jinma 284 sold, Kubota BX2660, IH Cub, Case 580CK, Minneapolis Moline 4 Star (sold), TYM 574, Furukawa FX-040
Last week reached the 10 month mark since notifying my TYM dealer that my 2022 T574 displayed the MIL (malfunction indicator lamp) and DPF light on constantly. It has also been 10 months since he spoke to plus emailed his TYM territory manager of the problem. It has also been about 8 months and five months that I wrote 2 letters to TYM South Korea. The DPF has a 6 year warranty that I believe is federally mandated. But I have heard from no one about getting the problem fixed. Not the dealer, not TYM-USA, and no reply from South Korea. I've gone though this before. This is my second T574 that has had this exact same problem and after 30 months, 20 trips by the dealer to my farm, hauling the tractor back to the dealership twice, and my contacting the Pennsylvania State Attorney Generals office it was finally replaced. I guess I should do that again. Or just keep using it with the lights on and trade it for a good tractor, which TYM is not, made by a company that values its customers.

JUST curious, have you tried this procedure to reset the DPF controller?

Can you go forward with a Lemon Law Case or Magnuson Moss Federal Case?

Sometimes the only way to get attention is by serving them…

Thanks for the great info. My 2022 should be warranted until at least 2027.
Where did you find that reset procedure? I am sure my dealer never did that in his 20 visits. I anxious to try it. Thanks.
The PA Att Gen never applied the automobile lemon law and I am afraid any other legal action will cost more in attorney fees and anxiety producing time then taking the loss trading it in on a good tractor.

No such thing as a "lemon law" for tractors.
California has Lemon Law for consumer products not limited to only cars…

The distinction often comes down to business or consumer use…

In California, remedies for defective tractors can involve various legal avenues, depending on the specifics of the situation, such as the intended use of the tractor (personal or commercial) and whether a written warranty exists
.
Here's an overview of potential remedies:
  • Lemon Law (Song-Beverly Consumer Warranty Act): While commonly associated with cars, California's Lemon Law can apply to some tractors, especially those considered "consumer products" used for personal, family, or household purposes.
    • If the tractor has a substantial defect that impairs its use, value, or safety, and the manufacturer fails to repair it after a reasonable number of attempts, the manufacturer may be required to replace the tractor or refund the purchase price.
    • For commercial vehicles, including some tractors, California's Lemon Law protections apply if the vehicle has significant defects that affect its use, value, or safety and the defects persist after reasonable repair attempts.
    • A reasonable number of attempts might mean at least two for serious safety defects or four or more for other substantial defects.
  • Product Liability Claims: If a defective tractor causes injury, you may have a product liability claim against the manufacturer, distributor, or seller.
    • California has strict liability product liability laws, meaning you don't necessarily have to prove negligence, only that the product was defective and caused the injury.
    • These claims can be based on manufacturing defects (error during production), design defects (flaw in the product's design), or warning defects (failure to provide adequate warnings or instructions).
  • Breach of Warranty: If the tractor came with an express or implied warranty, and the manufacturer or seller failed to honor it, you could pursue a claim for breach of warranty.
    • California sales include an implied warranty of merchantability, meaning the product must be fit for its intended purpose.
    • If an express warranty was provided, it must be honored.
  • Magnuson-Moss Warranty Act: This federal law governs written warranties on consumer products, ensuring clear terms and providing consumers avenues for dispute resolution and court remedies for warranty breaches.
    • It applies to tractors if they are considered "consumer products" used for personal, family, or household purposes.
Seeking legal recourse
  • Keep Detailed Records:Document all repair attempts, including dates, descriptions of the problems, and invoices.
  • Notify the Manufacturer:Provide a written notice to the manufacturer, allowing them a final opportunity to address the issues

The oddity here? You bought a domestically sold tractor here.

For me, I bought a restored 1981 Yanmar Gray Market machine. Even with the 1-yr warranty, nothing went wrong. Its been since 2014, 11 years ago since the purchase at a fraction of the cost of any new machine.

You are not along. TYM, LS, and Kioti owners are having very much the same results of ignored support for warranty.
