I know I can count on varying opinions as to what to do here.

Background: I have a neighborhood bully who wanted to drive across my property to get to his although there was another road 20 yards away that he has been using and maintaining. We told him no and he sued us for a prescriptive easement. The case is almost a year old with no progression. His property line is about 100 feet from our house/cabin.

So for the past 2 weeks before Memorial Day, I was building a nice 20' x 12' deck off the house. Saturday we smelled a fishy smell that was bad. Lo and behold he had dumped about 30 - 40 dead fish and parts on his side of the property. He has done this twice previously in small amounts (3-5 fish) and we just shoveled it up and disposed of it properly. This time it was overboard. We called the Nebraska Game and Parks Game Warden to file a complaint because it was disposed along "a body of water" a direct violation of game laws.

My question. What would you guys do? Load it into the bucket of my tractor (Tie to TBN) and dump it on his front porch? let the law handle it? or???? BTW he has about 225 acres where he can dispose of this stuff. I have to leave soon but will check back in the morning for your thoughts.

In any situation like this, my advice to both parties is that I would let the law handle it and keep detailed notes on each incident and interaction. You will only weaken your case by going onto each others property.

Several years ago, my neighbors; brothers with adjoining land got involved in a dispute resulting in guns being pulled, arrests and one brother having to sell the family farm and move out of the area.

Let the law work it's course. And don't go on his property to dispose of the fish again.

Involve the law to the fullest for a much needed "paper trail" of harassment. If he farts on your general direction, report it. Keep a log of what he does that might be considered harassment and take photos of stuff like this to. (keep a phone w/camera on you)

Normally I'm a fan of live and let live...but if he's sueing you already for access he doesn't really need *and* being a bonehead about it then it's best to protect yourself as much as possible. And in this day and age that's with a paper trail, photo evidence, keeping your own nose clean and letting the law take care of it. Otherwise he sounds like the type to make someone's life a living ****.

Must stink living near that.

i know it's hard but the best way to get him is to ignore him. it's better for you too! I'm sure he is disappointed that his suit is not getting him very far. just go about your life and defend yourself using your rights...he will get tired and pick a fight with someone else to keep him occupied. remember...never fight with a pig, because pigs get dirty and they like it!

How big is the parcel your cabin is on? What do you do there? Is it for fun/relaxation? If it is and it is a small parcel I would look into selling it and moving away. How much fun or relaxing are you going to have if you have to contend with this garbage? If its a family cabin where its been handed down for generations then I understand not wanting to sell but if its just a get away place then I would start looking for a better place. No one will win in this situation. Your already losing money having to fight court battles, I imagine your stress level actually rises when you think about this place as well.

If you don't want to sell and still want advice on how to handle the neighbor then never step foot on his property. If there is a major situation then call the law. Don't call them for every little minor thing though as that actually would work against you. Other then that just smile and wave. Smile and wave. Even if you dislike the guy you will feel better after smiling and waving to the idiot.

The guys on here are full of great information. I bounced a similar topic off them a couple weeks ago just because I wanted to make sure I didn't do something wrong. Turns out I didn't, I just have a rather rude neighbor and I am thankful to have learned that very early on. Good luck to you with your situation.

Get a few huge boulders and put them in the pathway of where he is encroaching.
