Interesting thread and allot of points have been brought up that I would have never considered. Thanks.

As to sending an email to the bank, I think that was a waste of time and effort. The bank doesn't know who sent it and should never trust the source of an email. The same is true for giving out information out over the phone.

The only way to make sure you get this taken care of is to go to the bank and speak to a person face to face. Take notes and be sure they see you taking notes. Ask them what the law is and what they are allowed and not allowed to do. Write it down. This will make lying to you somethng that they will usualy hesitate to do.

If anybody else shows up at the house, get their ID. Make a note of their name, discription, vehicle type and lisence plate number. These activities on your part will make them very cautious and much more likely to opey the rules and laws that govern them.

Ask them for the license plate # of the van.

Then go to the police station & check if its registered to your address or
someone elses.

Put a stop on all new credit with one of the credit agencys for a small fee.

The person that buys a car, can no longer make the payments, then refuses to return the car to the lender is the thief. Not the repo man. :mad:

When I said that repo men 'steal ' cars I mean in the sense that they take them utilizing methods often devious & stealthy. I recognize that what legitimate repo men do is both legal and honest. However, in all aspects of life there are individuals that are less than 100% honest. I wouldn't voluntarily let anyone search my property for anything as vague as the original post described. My suspicion of them is no less valid than their suspicion of me, hence invitation of a mediator, i.e. local LEO, should ensure ligitimacy to the entire situation.
Without meaning to hijack this thread, technically, failing to fulfill a payment schedule for a collateralled item is not theft unless intent to never pay can be proven. This is evidenced by lack of significant prosecution of deadbeats for theft. I believe that paying one's bills is fundemental but understand how people get behind. Is a person that falls on hard times and misses some payments any more a thief than an a salesman that convinces a customer to buy something on credit without seriously evaluating their ability to pay?

Not in Texas, or not unless a lot has changed since I retired. The repo job can be a bit dangerous because those guys really do not have any authority. They have to rely on the cooperation of the buyer, or rely on a sneak taking of the vehicle. They cannot break into a building such as a garage; they have to find the vehicle outside, get it and be gone before the buyer comes out and catches them. And the police cannot help them.

There is, of course, another way. The lienholder can go to court and get a court order and, with the court order, get the assistance of a constable to take the vehicle back. But of course that would mean paying court costs, attorney's fees, a lot of time since the court would send a notice to the buyer, set a date and time for a court hearing at which the lienholder or a representative would have to appear, etc. It's much cheaper, quicker, and more efficient to pay some guy $50, or even a couple of hundred, to find and gain possession of the vehicle.

Click here to read a short story about a repo man that was murdered in an alley here in my town back in 2002. His name is Gary McCracken and he was two years older than me. I worked with him as a lifeguard in high school. He was my head lifeguard. His murder is still unsolved. He left behind a wife and family.:(

If you want to get their attention send a certified letter explaining what you have already described. If the bank or any of their agents would like to consult you further on the matter your fee is $300/hr billed in 15 minute increments.

If someone calls or visits and asks a question, send a bill to the bank for $75.

I'm pretty sure they will leave you alone.

What upsets me is not that the bank people checked, but that by now they should realize I had nothing to do with that van!

I fully intend to find out who those two people are, and how they got the info about me.

jlc they may have gotten your information from places that you have done business with in the past.

Finally, today (7/9/08) I received a letter from the bank... interesting part reads:

"Please accept this letter as verification, that [name of the bank] is aware that you are not associated with our account holder or the above reference motor vehicle. We have documented our customer's account to assure that you are not contacted regarding this vehicle or account holder. Please accept our apologies for any inconvenience this matter may have caused".

What the bank has not done though (and they may not be able to do so by law?), is to give me any details of the account holder who used my name, and how that account holder got all the unlisted information about me.
