Hi, I posted something before about these towers but cann't find it. This tower nexted to my property line and about twenty feet from my garage and 100 feet from my house is got me worried. A tower just like this one nexted to me fell down just like a tree 30 miles from me. Here below is a link about the storm which took the tower down and it was a F1 tornadoe. We have sometimes storms like the one in Crossville, Tennessee.

Obviously it is not on your property. Your neighbor is the one profiting from this tower and no consideration was given to you by the owner or cell company. This is where local ordinance would have to be implemented. Frankly, I'd hate to watch that being constructed by my home and having no recourse. Good luck!

From posts on this forum and my own experience, I think you're getting off easy in the 'bad neighbor' department. Try to get used to it and enjoy the excellent reception!

I wouldn't expect them to make a mistake, but you might check local ordinances. I was under the impression that most codes call for a structure like that to be far enough from property lines to not hit adjoining property if felled.

They have them in back yards in tight, city neighborhoods here. The house lots are 65X135. The towers are 250+ feet high. If it were to tip, it could potentially take out 4 or 5 houses. There is little you can do once it is up. The only thing you can do is protest loudly before they go up and hope that is enough.

The controversy over the placement of cellular phone base towers (Cell Phone Towers) in residential areas has been growing in recent years, as more information becomes available about the health and environmental impact of exposure to such towers.

Current law permits companies to erect Cell Phone Towers without notice and without prior approval of the community or any governmental entity. In fact, some states have a law that expressly prohibits localities from using zoning laws to regulate the placement of such towers.

Thus, local officials have no oversight over the placement of the Cell Phone Towers and no authority to prevent them from being erected even in areas where the community strongly objects. However, some communities have been allowed to create ordinances requiring that the towers be disguised.

Now, for the good news....

New Technologies could eliminate the need for wireless towers in as little as 5 to 10 years.

First off are you sure its a cell tower? People like to assume everything is cellular. There should have been permits filed, find out who is installing and ask them.

Tower dont fall they collapse. They fall in on themself. They dont tip over and retain full height, so a 200ft tower doesnt have a 200ft falling zone. You would be lucky for half that.

Having a cell tower next you doesnt guarantee ANY better reception. First it would need to be your cell provider that is using the tower. MOST cell companies dont OWN or erect towers. They lease space from a tower company. Also right under a cell tower puts you into a cone of silance for radio signals. All the energey is being directed out a the tower, not down so close.

Finally, There is little to nothing you will do to stop a tower from going in once a building permit and or construction has started. There little you can do prior to construction, The tower company has more lawyers that you have and will bury you in red tape when the tower goes in.

I have a 260' tower on my property. It is located in the corner and is within 25 feet of 2 property lines. We got the blessing from the plan commission, zoning, etc. We did everything required at the public meetings, etc. It turns out it is pretty easy to get permits for these towers in some areas.

I don't even think we had to notify the neighbors, but we did.

However, if it does fall, it will not hit MY building /forums/images/graemlins/grin.gif Now I will admit that I wear a tin foil hat when I ride the tractor near there so the government's radio signals can't penetrate my brain /forums/images/graemlins/wink.gif

take photos of your house, garage and any structures that could be damaged if that thing fell. From the one photo here I would say that collapsing is not a sure thing. THEN IF this thing goes..............hire a lawyer and sue the heck out of anyone associated with it.............
