I gotta say, I am happy Gilmour won the suit, and hope he wins his counter suit.
I think Suzi ET AL should indeed have to pay. Her comment "The $50,911 in attorney fees would impose a steep financial burden, she said. “We can’t afford that kind of money.” Gave me a chuckle :laughing:
Did you ever consider that maybe your stupid lawsuit against Mr. Gilmour for (who knows how much $$$$), would impose a steep financial burden on him.....and that he couldnt afford it?
I agree with James.....we have too many stupid lawsuits.....that no one every really wins in the end. the only thing getting accomplished is making the lawyers wealthier, and the attorney profession prosper. People need to really think twice.
But one thing I still cannot comprehend.....Why in the world does it cost soo much money to get a simple clarification of a law regarding Ag processing vs AG activity? And why such clarification even needs to go in front of a judge? Just dont make sense.....
But....in either case.....Gilmour did absolutely nothing wrong, Suzi ET AL, filed a lawsuit and were wrong. Why should Mr. Gilmour be left hanging with $50k worth of bills for doing nothing wrong? And Suzi get off the hook for being wrong?
This whole story reminds me of a guy I used to work with (who I never got along with on about any topic). Major metropolitan areas are constantly expanding....out into rural areas and farm land. Cause all the city yuppies want out of the city to enjoy country lifestyle.....then cannot handle the things that come along with it.
This guy, Bought a house surrounded by fields on all 3 sides of his property and the road in front. When the farmer would harvest the field, depending on wind direction, Would cause some of the corn chaff or bean chaff and dust to blow into his yard (and the dust to blow across his yard). Listening to him rant about how inconsiderate this farmer was, and that he was littering on his property, and not cleaning up after himself etc etc etc. I asked him what the big deal was, just mow the crap up, it will be gone in a few weeks. He said that wasnt the point, it made his place look bad. I told him to move back to the city. And what did he really expect the farmer to do? His solution was to have the farmer not plant for 1-2 passes around his property line. Aside from that being the dumbest thing I have heard, I told him that if he did that, then next year you would be b**ching about all the weeds 3' high around your property blowing their seeds on your lawn. He said that next year if he plants right to the edge of his yard again, he was gonna go out there and spray it all with roundup:laughing: When I told him that wouldnt work and why....he said he would just mow it off then.
Some people just cannot be pleased.
