Mstraebel: this type of stuff happens to all genders. It is the greed of one party that usually causes the grief. The good thing for you is that the "error" was caught before the posts went into the ground. I would simply follow the UCC which is effective in all states, with the sole exception of LA., and ship the non-conforming goods (posts) back to the supplier and demand conforming goods within ten days of receipt. Hopefully the full purchase price has not been paid. Just sayin, Andy.

Osage is what we call Hedge Apple here. And they grow very well here.

I'm thinkin they must have spread from their origin in the last couple hundred years. Just haven't gotten here yet as far as I know. Commanchee's used this wood for their bows and I believe this tree was used by Roosevelt to tame erosion in the Plain states in the mid 30's.
I've seen the tree in South Eastern Canada but it was no where near New England in the 19th century. The French named the tree "bodock" or "wood of the bow" Don't know who named it "hedge apple"

They were transplanted up here from Texas. They make a good "hedge row" tree. I.E. a fence made from trees. That's where the Hedge Apple name came from up here. I've got a half dozen or so. Not a particulary desirable tree. They have thorns. Some (stupid) horses eat the apples and it gives them the squirts and stomach cramps. Horse is pretty miserable for a while. The wood is so hard that sparks fly from a chain saw blade when cut even when the wood is green. The trunk is short and most time crooked. But if you can manage to get a fence post out of a Hedge Apple tree it will last until the end of time.

i thought the english named it bodock for it was the wood the english used to make long bows.if bodock does not grow up there naturally the pilgrims may have imported it.arrow look around bodock is probably around there too.auburn has a fence post list like that one.i have no idea where they come up with their numbers.there are ceder post on my farm that have been there over 50 yrs. already 3 times the university's claimed life. bodock and wild rose were once recommended by auburn for fences .

See if you can't get the supplier to deliver the correct material and take the old material back. Saves a fight over return shipment costs. Save the ship it back and make a demand method until you really need it.

Don't pay any more than the 50% you put down until it is all resolved.

Did you happen to put the original money down by credit card? If so, you have a lot of protection. Write a letter to the credit card company disputing the charge. They will take your initial deposit back from the vendor and not charge you any interest on it until the dispute is resolved.

The vendor will be very interested in resolving the dispute. Enough black marks like this and they will take away his ability to accept credit cards, which will drastically reduce his business potential.

I think it is a variation of the French name for the tree, Bois D'Arc refering to it's use for longbows.
