I've been looking for a tractor with a backhoe and loader for some time now to clear 3-4 acres of wooded land. Would this be a good deal if its in good shape?

Sounds a little under priced to me. I hope there isn't a loan against it that creates a problem. I guess I'm just a skeptic.

I would not consider purchasing it without driving it first but how do I know if it has a loan against it, is there a title just like a car?

The 35 HP is the gross engine HP (edited to correct the HP rating). PTO HP is 28.5 (Thanks to JimmyD for the correction!!).
Decent price, so have cash (or a good deposit) on hand when you go look at it. I suggest you not wait too long. If it's a good tractor, it'll go fast.
BTW, it's possible this is a rental machine (be sold by a rental company), so give it a good look and don't be too starry eyed. If the guy says it's in storage out of state, it's probably a scam.

I was pulling the HP from memory. A 60 year old dude should never do that!
