Is the contractor at fault?

Take pictures post here, and get an estimate to fix the problem from a different contractor. After you have an estimate from a different contractor, go to the first one with your problem. Keep a written recode of everything which happens.

In some states a contractor must warrant his work for one year. Your deadline for doing something may be coming up soon.

In many cases, the only real fix for a cosmetic concrete problem is tear it out & do it again. Not what you wanted to hear, but a very real possibility.

Or just use the existing concrete as a base for a new pour.:D

I don't have a lifetime of experience with concrete, but pouring more over a bad installation is seldom a good idea. If the issue is settling, all that is going to happen is that the new pour will settle as the one underneath settles.

In this case, if the problem is spalling, the internal pressure which causes the spalling in the old concrete is more than high enough to uplift the new pour. You might get away with it, but you might get a lot of cracking in the new pour.
