I can't for any reason figure out why we, as land owners, need to post any signs. If a person does not own the ground they are walking on and it is not clealy for public use(sidewalk, parks,...). then the person should have no rights if something happens to them on that land. The only thing we might need is a fence to show the dividing line between ours and others. What is really needed in this country, is when someone loses a 'I'm a idiot and you will pay' case, the lawer must pay at least half of what they were sueing for to guy one the other end. No passing the cost on to their client, it has to come out of their pocket. And the poor guy being sued should get at least 3/4ths of what the other party was sueing for automaticly without futher court processes. Take the profit out of the lawers pockets and the number of cases should dry out real fast.

I would just be happy if the plantiff lost, he had to pay all legal fees for both sides. And had to pay upfront and didn't get any money untill the case is compleatly settled. Also the lawyers don't get paid untill its over with. That would cut the amount of cases down and speed up the rest.

Now that we are telling insurance and lawyer stories, I have a fun one. My father owned a small life insurance company for about 30 years, selling mostly small policies. One day the monthly premiums quite arriving for a particular policy and after several months (required by law), the policy was terminated.

About 2 months later the wife of the policyholder called and asked what it would take to place the policy back in force. She was told "pay the back premiums". She did, the policy was reinstated. Another 2 weeks goes by, she calls again and says "my husband died". She was requested to send a copy of the death certificate. When that document was received it was clear the man died during the period the when the policy was not in force, well before the back premiums had been paid.

The claim was denied. The wife hires an attorney and sues. My father's attorney reviews the case and says "it will cost you $30k for me to defend it, you might as well pay the $5k claim. It will also save a lot of time and agony".

This was not all that odd of an event. I used to here 4-5 stories a year that were very similar. This is like shoplifting, we all pay.

We used to be required to have posted signs every so many feet to legally keep out trespassers but a law was passed (in Mississippi) a few years ago that says ALL land is posted by the landowner and you must have written permission to be on it. Despite this you don't hear about a lot of trespassing convictions. Most of it is done during hunting season and it's hard to catch them on the property, identify them and get a law enforcement officer out there in time to make the arrest. Some hotheads try to make the arrest themselves. When both parties are armed, it makes for a dangerous situation.

Check your state law before you get the signs. The law is very likely available on the Internet.

I'm sure the law with be specific on the requirements for posting the land. For instance in North Carolina, the statute specifies the distance between signs, I think it is 200 yards as well as the size of the signs, 120 square inches. Furthermore there is some verbage that makes me think the entire property needs to be enclosed by the signs.

Why is this important? If you do get into a trespass situations, a smart lawyer will start asking if you have posted within the law. So if your signs are 210 yards apart or 100 square inches or only on the northern edge of your property, you might lose since you had not properly posted the land.....

Make sure you observe ALL legal requirements regarding sinage size, separation, wording, etc. Yes they will collect bullet holes. My new mailbox WITH reflectors was TOO tempting. I patched it and removed the reflectors with no repeat episodes. I bought this place almost three years ago and just recently moved onto the place, the part of Oklahoma where the maps say, "There be dragons here, Terra Incognita, and things like that. Around here slip joint pliers are thought of as HIGH TECH. I turn away polite requests to fish my ponds 3-5 times a week out of consideration for liability problems. If common sense were not such an uncommom commodity I would designate half of my 10 ponds for public access.
