if you see tons of them, it's a fair bet that they are being manufactured by a true manufacturer and not by billy-bob in his back yard. if it is being built by a manufacturer, then it's a fairly good bet that they are confident that the trailers are capable of carrying the load they are posting. they're in this to make money, so making it as light as possible to do the job is the most profitable, and legal fees are a loss of profit, so they've probably done enough research to figure that they are marketing and selling correctly.
if you are worried about someone extremely modifying and reselling in the secondary market, then it goes back to the buyer beware issue. i'm not saying this because i believe that it is ok to be shady in your selling practices, but because anyone who is buying private sale absolutely positively must know what they are buying. what if you are buying a trailer from someone's widow? do you expect her to be able to tell you what it is? it's your responsibility to know what is right and wrong if you don't have a knowledgeable salesman to help.
i know many people like heavy duty over-engineered products because they feel safe knowing that they will not break, but i personally prefer to use the correct size one, and use it as intended. whenever i see someone selling something advertised as "home made heavy duty" i rarely even bother, because the only thing i can be guaranteed is that it is so heavy you'll need to up yourself one class in vehicles to haul it around empty. usually it's not designed well either, so it won't haul any more than the lighter one.
