Yikes.. horrible accident.
I'm also not going to assign blame.. cuz we don't know al the particulers ( was driver of auto speeding?.. etc. ).. however one thing does come to mind.. Were the obscuring trees in the public ROW? If so.. they are also 'partially' to blame. The GC i work for was aprt of a lawsuit 'similar' in nature. There is a road north of our fenceline.. there are trees in the county maintained ROW.. a car pulled out in front of a semi.. and there were deaths involved. We were sued.. driver of semi was sued.. and county was sued.
In the end insurance co's for all defendents came up with a group settlement to prevent it from going to court.
Very next day the couty had tree trimming crews out at every intersection in it's jurisdiction cutting down everything within 100' of a crossway.. etc. It was needed. We had a few intersections where tree's were litterally growing inches from the shoulder of the road.. and it was darn hard to see 10' down the road to try to get out with the flow of traffic...
