I hope you prevail. My experience with lawyers and judges have all been negative. It seems now a days there is a lack of respect for the rights and property of others that was present in the past.

Before you do anything else, I suggest that you hire a land surveyor. One question which WILL be asked is if you truly do own the property. Once that is established you are going to have one very unhappy neighbor. Because it was deliberate and the amount of damage involved, he may even be eligible for criminal charges.

The person doing the work is also at fault. If a legitimate business he will have insurance for this type of thing. If he's a licensed arborist, at the very least he could lose his license to do business.

Take some advice here.... stop posting about it on public forums until the lawsuit is settled. Everything you say (post) can and will be used against you by folks with money and lawyers. Hope you get some satisfaction and resolution. Bummer about the tree and surroundings.

Your lawyer will know in your state... In NC, cutting a tree not yours is treble damages (So I've been told) If true for you ... That tree and the others will be very expensive indeed.

Unfortunately for someone who can afford the courts, lawyers and fines there is no real justice.

I have the same problem here, but instead of idiots its people who do not understand our laws and then pretend they don't understand English. As hard as it is to get quality trees to grow here, I'd be doing a lot more than a civil suit. It is trespassing. If the local law enforcement claims they cannot do anything I would raise cane until they do.

It could be hard to blame the tree company . If the neighbor told them the tree was his and on his property , They would have no reason not to believe him . Its an unfortunate situation.
