When is it copyright infringement?

Not wanting to reply to the post that is being kept going about some Mahindra's being nothing but trouble and having a question that pertains to where it ended up I thought I'd start a new post.
I noticed that a dealer I visited recently had some t shirts printed with the Mahindra logo and his dealer name for the employees. If one had some shirts screen printed or embroidered with the Mahindra logo would that be copyright infingement?

Maybe Mahindra has some co-op funds the dealer can use for his advertising. The ads would just need to use approved logos and the shirts would approved for partial or full re-imbursment of cost to purchase.

Am I correct in assuming that if an individual had these shirts made even without any intent and not in any way linking his establishment with Mahindra it would be infringement? i.e. if you could get someone to design and print or embroider the logo would you have to have Mahindras permission?

Oh boy, that's a legal question and I wouldn't have a clue. I can only guess and that guess would be, yes, you need their permission. However, if it was done for personal use and not for advertisment or financial gain, I doubt a manufacturer would take notice.

Not knowing the actual wording of the Mahindra contract, what I can do is tell you my experience. My company represents many companies, some of those companies grant us a limited license to use their logos for cooperative advertising purposes. Some companies do not grant any permission at all. So my guess is that Mahindra, in their dealer contract, probably grants their authorized dealers some limited permission to use their logo in some reasonable ways. Like co-branding a T-shirt with the Mahindra logo and the dealer's name.

Yes. But many people violate the law and don't get caught. Its both wrong and illegal.

I suspected as much. John Deere has anything you want with their logo on it. In my opinion that's why they have developed such a cult following. I see girls with tees all the time who have never even seen a tractor up close and maybe not at all. My kids are proud of their farm operations and they want to show that they have a Mahindra tractor, but so far they can't.
