I am sure the box truck would be cited. You cannot swerve to avoid an accident just to cause another one. If I was the boxtruck driver, I'd rather take my odds with a car grazing me than to tangle with an 18-wheeler.

Just like deer accidents. Hit the deer, and you arent at fault. Swerve and miss the deer, but lose control and go off the road and you are at fault.

Swerving is dangerous, especially at 65mph+. Best to just stay in your lane and use brakes if necessary. What if it had been a minivan full of kids next to him and swerving caused them to hit a concrete barrier?
