Couldn't agree with you more CTW. Where you confuse me is in earlier posts it sounds as if you advocate setting traps, treating signs, windage flags and being ready to shoot if you see someone on your property with a gun. Guess the "rules, laws and limitations" are different down your way.

These are perfectly legal and justifiable. Posted signage is not against the law nor is erecting windage flags. Encountering those on your property with a gun? Where did I lose you on that one? If you're fumbling for a rule book in the pasture trying to decide how to handle armed individuals then you're already behind the 8 ball.

Well, what a toppic. Land is a privilage, and a curse. I have 5 acres with all my neighbors owning at least that much if not more. Close group of folk and that helps "A LOT"!

We posted "NO Trespassing" signs as per the local code, as suggested by our Sherif durring our Home Owners meeting several years ago, when we had a rash of mail, vehicle, property theft.

Additionally we all have taken to gun ownership and leave our targets out on our land and regularly run through ammo, both on week day's and weekends. The thunder clap through the valey leaves an indelible impression on people for miles. Some w/e's when we are all out and firing on our separate ranges it sounds like a "WAR".... :D

Since... we have not had a single item stolen, no trespassers and best of all the traffic along the main road is "WAY" down from what it used to be.

Guess people think that, with that kind of gun fire and # of tractors, dozers and forest.... anyone trespassing might just "Dissapear".

Be very, very careful of Booby traps. You can't setup a shot gun at your front door to shoot an intruder. Dig a tank trap at the gate and you are liable for the damage. :(
I had the same problem with kids. I setup a cramer with a sign reading, "If you are reading this sign, too late, I have all the pictures I need on my home PC" :eek::eek:
Dragged the snots into court, took them for their college funds. Their lawyer tried all sorts of BS. I simply asked if I can go into his house and do as I wish? The word got around the HS, no more problems. :D

It sure is nice to hear a success story where the landowner was able to win a case. It sounds like this is a situation of strike first and strike hard. I hate the idea that our country is run increasingly by litigation rather than the rule of good laws, but if that's the legal environment we live in, then our decisions need to be based on that reality. Fight fire with fire. Or, fight the fear of liability and litigation with liability (for damages) and litigation.

I think this is a hard one to answer. You have a right to protect your property but the same trap you set for a gun toting thug might get a 16 year old couple trying to find a spot for a bit of romance. They both might be on your property, but it's just not the same. Good locks, good fence, good gate and some good luck might be the best way to go. Berms and logs are good too. People are for the most part, lazy. they will look for another place that is easier.

Unreal but true story.. Two summers ago, friend of mine is on his own farm. When he and his brother see 6 people on horses entering there pasture field. They <w/o weapons> drive up to them and simply ask them to leave. They had entered the field by cutting the fence BTW. OK, long story short, 5 men and one woman, all drunk and or high get chitty with the owner. Attack both of them, basically 5 on 2, beating them with everything they can get there hands on. My friend, on the groud now see's 3 of the men on top of his brother. Crawls to his truck and manages to get in. One of the tresspasers high on whatever stands between my friend and his beaten brother. Well my friend ran him over. Did not kill him but hurt him pretty good. In the end my friend <the landowner> is charged with felonious assault and pleads to much lesser charge. Slug sue's him and insurance company settles the case for 100grand.. Sad but true story.. Tied up in court for nearly two years. Settled 2 months ago. Landowner model citizen no trouble ever. Slug RAP sheet nearly 10 pages long.

I thought you guys in America, with those second amendment rights, could just kill a thief on your own property and get away with it...

I think i misunderstood that part, and the USA is just as bad as Holland...
I think i'd put it all on freedom of religion and see where the lawyer gets me with it: Turks do get away with it fairly cheap, for killing their sister when their father didnt approve on the secret boyfriend. Its because its normal in their culture... So when i can make the judge believe i am not part of ordinary Dutch culture and killing is normal where i come from, i'd be getting away easier ???

Last year in Germany, a 22 year old girl of Turkish origin killed 2 motorcyclists (both fathers in their 40's) because of dangerous driving. She was heading for her boyfriend (boyfriend of Kurdish origin, Turks hate Kurds) of which her father didnt approve. Father sent 23 year old brother in another car to stop her, which lead to this situation. Girl got a jail sentence, as well as her brother. Father did not.

Law stinks. Everywhere. :(

I can tell you from experience there is no deterent like living on the property. Neighbors that are tired of the problems can be a great help too. My property has 2 entrances, both used by gas production companies, which means extra keys floating around and gates that they "forgot" to close:mad:. They wanted more entrances, I refused because I wanted access to be as limited as possible. When they "forget" I call the main office, they remember for a long time after that. Part of my property I rent for a hunting club now, they are very effective around open seasons. Signs, good gates(concrete and steel) and just being a total jerk to anybody you catch:p really help. Especially being the total jerk, word gets around fast when you put a couple through the wringer and even faster if you can get a couple busted. Game wardens here were much, much more help than the local sheriffs dept:(.

These are stories that really burn my backside. I know this isn't true everywhere, but it should be. Once asked to leave and the confrontation began, then lethal force should be allowed. I know they could shoot back. But my guess you hit someone with a hollow point or better yet a black talon and people are going to stop and take notice. Now if you're apposed to killing someone or you're apprehensive then you shouldn't be carrying a gun.
The property I own wasn't given to me, I had to work for it, and I should be allowed to protect it. If you're in a rural area calling the police is useless, other than to clean up the mess, because it takes 45 minutes to an hour for them to respond. IF THEY RESPOND.

Ranchers has a beef with trespassers after freed cattle cause two wrecks

SIERRA VISTA A number of cows from a nearby ranch escaped their range due to damaged fences, causing two separate vehicle wrecks this week.

At 9:23 p.m. Wednesday, the Sierra Vista Police Department received a call about a single-vehicle accident on Charleston Road in which the driver had to swerve to avoid three cows on the road. The driver over-corrected and ran through the fence of the Cochise Memory Gardens cemetery, 5590 E. Charleston Road.

The driver was not injured in the incident.

Less than an hour later, at 10:11 p.m., police received a call about a vehicle that struck a cow in the 300 block of Highway 90.




Police report that the driver initially moved to a different lane to avoid one cow but then struck another.

The driver received minor injuries and was treated at the scene, and the vehicle had to be towed.

No citations were issued in either incident.

Both accidents were the result of cattle escaping from the property belonging to the Finch Cattle Co.

Owner Mike Finch said that, due mainly to local hikers and ATV riders looking to cross onto his property, it is a daily struggle to repair the barbed wire fence encircling his land.

His holdings are along Charleston Road to Moson Road as well as along parts of Buffalo Soldier Trail and Highway 92 east of the mall.

He can sympathize with those who appreciate the outdoors and want to spend time riding four-wheelers and hiking, Finch said. However, trying to keep up with repairs to his fence is proving daunting.

展e do everything we can to cater to them, he said, including leaving gates open along the fence to allow people to pass through if need be.

It is not uncommon for Finch to drive more than 100 miles in a day along the outskirts of his property in order to make repairs to his fence, he said.

Finch said that while some of the damages are caused by illegal immigrants crossing into the country, the majority of damage is caused by hikers and ATV riders.

The loss of a single head of cattle can cost approximately $4,000, he said.

Despite the constant repairs keeping him busy and the financial impact of losing cattle, foremost in Finch痴 mind, he said, is what should happen if someone driving on a road one night is seriously hurt because one of his cattle got out and onto the roadway.

Finch said that he hopes anyone looking to take a short cut through fenced property will think of these dangers next time and reconsider cutting down or otherwise damaging a fence.
