My opinion is that GM has done truck owners two wrongs here. First, they don't provide a hitch rated for the trucks towing capacity, this is true even on my Silverado 1500. Second, the real trouble, they don't tell you in the owners manual or anywhere else that they've done this. I've heard of some cases you can find a rating on the hitch itself, but I haven't found one. My manual clearly states I can tow 8000lbs, my hitch I believe is rated for 4500 to 5500 based on what I've found on the internet. I'm really glad I learned about this before anything bad happened. I think this lawsuit has some merit.
Sounds like this is larger than GM though.

To use the full towing capacity of nearly any pickup you need to count on beefing up some of the components. If you tow 8000 with a half ton you definitely need a brake controller, that doesn't come with the truck. And you need a little more hitch to pull a 8000 lb. trailer.

My 85 Chevrolet G20 Van was factory ordered with Hitch... it was less than $80 extra at the time.

I've always been surprised the hitch is rated for #12,000... about #4,000 pounds over the rated tow capacity of the Van.

The capacity is stamped clearly on the receiver as well as on a weight rated sticker.

Sort of reminds me of the heated windshield washer fluid wiring that was supposed to catch my tahoe on fire and cause all kinds of other mayhem or death. Turns out l a few people had a small amount of smoke and melted some wires, while the other 1.3 million of us seem to be doing just fine.

Dealer offered to disable mine for free and give me $100 for my trouble. I told him to stick it up his ____ I'll keep mine. My insurance company confirmed they will make repairs even if I refuse the recall. Love the heated WW fluid, so I'll take my .003% chance that it malfunctions.

If it happened on 1-of 1,000 vehicles, I might think differently, but 4 out of 1 million??????.....naahhh.

Or people with fat feet driving Toyotas. :D

I'd worry about road salt corrosion more than anything being the mfg'ers fault.

Actually, if would have researched it a little more, your hitch used with weight distribution bars is rated above and beyond your 8k tow capacity rating.

Sounds like this is larger than GM though.
My Chevy truck's hitch rating is the same as what the specs called for, 12K. 5th wheel would be rated for 15K. If it says 5K, that is likely without a load leveling hitch.

Typically the use of WD doubles the capacity of the hitch. So in this case 5K non WD, 10K WD

Stocker was very light and using the bumper as part of the hitch?!
