How long do you have to have it in your possession before you can file a mechanics lien. I would also charge storage from the day he was notified the tractor was ready to be picked up. I would also contact your local police dept. and give them a heads up on what is going on in case he tries something shady. This way its not his word against yours. You have been more than fair with this person and he still isn't happy and there is no way to make him happy without doing the work for free, So now it's time to show him your other side.

Like I said earlier, inside, or covered and locked, in an impound lot! I might even 'brush-up' on my "Mechanic's Lien" law options. And as a last resort, (especially if your in a small town), notify law enforcement that there is an issue 'brewing' that may escalate.......~S

I wouldn't want to take the man's credit card either, but assuming he has one of the brands you accept, can you refuse without jeopardizing your merchant agreement?

Now the plot thickens. How hes mad cuz he called today and wanted to pay by cc (knowing I already told him we couldnt do that) over the phone and with a cc we dont accept. He slamed the phone down and i havent heard from him since.

My wife and I run a small B&B and our credit card company told us to get a Guest Signature on our receipts. If we had a particularly "dodgy" guest, they suggested we include a phrase like the following above the signature

"I understand and agree to the charges and I will not challenge this billing with _ _ _ _ (the card company - VISA, MC , AE etc)"

Might help to get this behind you, but I do agree that having this guy bring cash and ride off into the sunset would be my preferred option.

Will not jeopardize the MA ... every merchant reserves the right... "Refuse acceptance of the card" go with cash all the way.

I would think his Merchant card agreement would have nothing to do with refusing to take a credit card. If that were the case there would be an awful lot of fraud going on out there. Every businees would be wide open for all kinds of crap.
There were plenty of times (automotive repair) I refused all methods of payment except cash, especially in deals such as this. Furthermore, to prevent stalling and bring an end to the problem, I advised the customer storage fees would begin to accrue within 24 hours. It was always amazing how fast the bucks showed up. Cash only--this whole saga has "red flags" plastered all over it. Mike.

Bob ... good thought. Our prints out of the machine ... "All sales final. All sales as-is with no exceptions" ... has yet to be challenged.

5.6.1 Honor All Cards
A Merchant must honor all valid Cards without discrimination when properly presented for payment. A Merchant must maintain a policy that does not discriminate among customers seeking to make purchases with a Card. A Merchant that does not deal with the public at large (for example, a private club) is considered to comply with this rule if it honors all valid and properly presented Cards of Cardholders that have purchasing privileges with the Merchant.

2. Honor the Choice
If the customer indicates that he or she wants to pay with a Visa card, the merchant must make sure that choice is honored. In other words, the choice is ultimately the customer's. A transaction can only be processed as something other than Visa if the customer has selected another form of payment. However, if a customer chooses Visa, it must be processed as a Visa transaction.
