Up graded tractor, Should I also get a new trailer?

You DEFINITELY NEED brakes - on BOTH axles, regardless of small vs large(r) tractor.
It isn't about trailer length, it is about un-braked weight.
Since you NEED BRAKES anyway,,, might as well get a longer trailer if you want/need the deck space.
BTW, the fishtailing had little/nothing to do with trailer size/ length.
THAT was ALL about load (im)balance.

I am having a hard time believing a 7k rated trailer has NO brakes whats so ever. Are you really sure? I would jack up one side of trailer and pop both tires off and the drums and take a look. I am willing to bet you have at least one axle with brakes since your state is one of 33 that has must have brakes over 3k towing weight.

Maybe he means he physically has brakes on his trailer, but isn't wired or maybe the truck isn't wired?

I see 16 foot trailers with 3500# tandem axles all the time advertised without brakes in Texas. Sometimes with 1 axle brakes (on rear axle) so that is not a fluke. If I had this situation, I would just add brakes to the existing trailer which would be much cheaper than trading for a new trailer. The length looks like it is plenty long for this tractor. From the first post it look like the OP should have sucked the backhoe boom up close against the tractor and fully curled the bucket. That would have put more of the weight over the axles and more evenly balanced the load. It also looks like he could roll the FEL bucket all the way down and set it on the trailer and give more forward movement which by doing those two things would have put more tongue weight on the truck to reduce the fishtailing.
Just properly stowing the backhoe and placement on the trailer would greatly increase the towability of this setup.

As pointed out by Reg and another poster the trailer fish tailing is a clear indication that you do not have enough weight on the tongue.
I used to have a 9' x 5' dumping trailer in which I could just shoe horn my B21. When I went to pick up the brand new B21 I wanted to back it in the trailer but the dealer insisted that I should drive it in. I foolishly followed his advice and tied the machine down. I got about 3 miles from the dealer and as I accelerated from 35 mph to 50 the trailer began to shake so violently I could barely keep my vehicle on the road. I had to grab the trailer brakes and get the rig stopped.
After cleaning my pants out, I had to unload the machine on the side of the road and then back it in and tie it down and I never had a problem again. I was towing with a 3/4 ton Suburban that weighed over 6000 pounds and my dumping trailer weighed in at about 4000 pounds plus about 4500 pounds for the B21.
From my subsequent reading I understand that in order to avoid trailer sway you need to have around 10-15% of the total trailer loaded weight on the tongue. Having experienced severe trailer sway once, I would rather have a little too much weight on the tongue than too little.

Its exactly what I was thinking, which is why i suggested go check for brakes pads on the trailer.
I agree with you on this, however I just don't see how DMV would let the OP register the trailer if it had a 7k rating and no brakes since DMV would have the vin number of trailer and there would have been a red flag already trying to register a trailer with no brakes over 3k. it would be illegal. I was hoping op would discover his trailer indeed has brakes on trailer, but just need to go and wire up the truck for it if he havent already.
The DMV here wouldn't know or care if the trailer had brakes or not.
I have purchased several 7k trailers without brakes in the past so I don't think they are that rare.
