I am thinking about selling some hay... I have never done this before and being in the liabilty geared country we are in I have a few questions to those who do. I am finalizing some of the logistics and started wondering this... If your selling hay and someone comes on your property to buy it do you have them load it? If so who is responsible if something happens say they slip and fall? Next what about their vehicles are you responsible for making sure that the vehicle is safe before leaving so nothing falls out? How are some of you handling this or is this a concern I should not worry about?

Of course 1) everything depends on your individual state laws which could vary and 2) anyone can sue for anything. Whether they can collect is another issue.

I don't sell hay but I've been buying it for ten years. As for securing the load, and responsibility when I leave the seller's place, i certainly assume that's my responsibility unless the seller would tell me how to load it and tie it down. No different than if I go buy lumber at Home Depot.

Most places I've bought hay help me load it. I don't know if that's common. Last week was a real treat, the guy had a hay accumulator which picked up ten bales at a time from the field and set it right on the trailer!:thumbsup: He had a teen working for him who packed it tight for me and helped me strap it down. Sure beats manually transferring one bale at a time from the hay wagon! :)

Now if I fell and got hurt loading the hay, could I sue the seller? As I said, anyone can sue for anything but I can't say about liability. Talk with your insurance agent. You DO have FARM insurance, don't you?

Pretty much the same. Have been buying it for over 10 years. Most of the time they help load and I tie it down. :)

Well I looked at it as you did with buying lumber at home depot, ... Its really sad that we have to think about these things anymore.

I don't sell hay either but do buy it. If I pick the hay up off the ground and load it myself I can buy it a little cheaper. We have boarded horses for decades. In Ohio if you are running a business you are a little bit more liable than just a homeowner. We have insurance tailored for a boarding operation. Farm insurance wouldn't be a bad idea IMHO. Maybe the local Farm Bureau would have some recommendations for insurance

As with the first post, anyone can sue anyone for any reason. That will include their health insurance company suing your home owner's insurance. I learned that if I get hurt on someone elses place (and I don't feel they're liable), I need to be careful if my health insurance company calls me up asking questions.
