belive it or not but i have a neighbor as bad or worse than the one mcbarb decribed. this guy don't own the property yet right now ha is the over seeer or adminstrater, but in time he will own part of it and he is one more nut case. every year he goes all the way around the property and hangs soap bars on the tree's in fence line thinking the deer will stay on that property. his son came on my property andd stole my tree stand. i delt with him a couple years ago. but we all know the property lines and have fence but this guy just does stuff he know's will make you mad. his moter is still living and thats what is keeping him from owning it but she is around 95 years old now. i know he will be a pain in the butt.

As bad as that is, it could be worse. I have read more than one story where people have been killed over property line disputes.

Only one side of the story was posted. The jury returned a verdict against him. The Appeal Court found no problem and upheld the judgment. He was ordered to pay. I don't think a jury, a Trial Judge and the Appeal Court could all been wrong after hearing and reviewing testimony.

As I posted on the other thread I was interested after reading, so went and found the legal case and all the associated records. I even looked at the property's online and saw the layout etc. There was a lot in the case that wasn't stated in the thread and some facts that I personally thought may have changed it a bit. I'm not saying anyone was right or wrong, but just that there are definitely 2 sides to the story. The damages seemed surprising, but at the same time the threshold is to convince the jury and the lawyer has a lot to do with that, sometimes more to do with it than the facts.

In terms of buying a property with easements, there's a right and wrong way to do with it. I own a number of properties, and with any easement it's important to have someone (lawyer) investigate them and make sure they are clear and make sure they don't hurt your interests. I for example have a trans continental cable easement crossing my property, It's clearly written, is in an area where it's so far from the house and any place I ever go that it really doesn't matter. On the other hand I have an easement to access my property crossing 6 other properties, that one is written extremely well and was something we closely investigated. Almost every property has some form of easement, not all are bad, but if written poorly they can be. Its important to fully understand what you're getting into.
