Problems with Trespassers

Where I live he could go to the magistrate and sign warrants for the acts and they should be locked up. But I agree, I believe there is some good old boy thing going on here. Not solving the problem properly now is what causes much larger problems later.

These people don't live on the property next to mine. They live about 8-10 mile away in another county & use this for a party place. This is on a dead end road & I am at the end. It is 7 miles to the nearest town. When you call the police it is usually at least 30 minutes before anyone shows up. They know this & try to get out before they show up. I had a situation where they stole the gate off of my other place & it took almost a month to get anything done. The county attorney send them a letter telling them to stop trespassing.

With all do respect I think that your trespassers are a lot smarter than your police.

I would get a small camcorder such as go pro or even use the recorder on your iphone/smart phone. Set up some trail cams that are well hidden so they do not steal them and get yourself some digital/video evidence. These people have broken a ton of laws i.e. assault, trespassing, malicious destruction of private property, larceny etc. It gets very difficult for one to defend one's actions when they are caught on film. After seeing such a judge should at least issue a restraining order.

That crap about them nudging your wife with a quad is BS. If someone did any of that to any of my family members they would have had a gun drawn on them. As far as I am concerned them doing that is assault with a deadly weapon.

Dang!

I'd have gone bezerkoid on them if they had approached my wife or kids or anyone else on my property. Then the cops would have a lot of paperwork to do after that.

The police say they have to catch them in the act in order to be able to arrest them. If they didn't see it happen it's my word against theirs. Ihave put up some game cameras but don't have anything on them yet.

The person that I bought rhe land from had a ladder stand still on the property & he was going to come back & get. It qas there last Sunday & on Friday afternoon I noticed it was gone. I called him & he said he had not picked it up. He also said that they had called him & cussed him out for selling out.

I would schedule a meeting with the Police Chief to discuss the events and go over all the physical acts against you and theft of property. I would also either set up video cameras or carry them with you. The key thing to do here is video them with out them knowing so they incriminate themselves.

Boy that is a tough situation. I believe I would call the District Attorney explain the two encounters, the fact that they have threatened you and your wife, have made physical contact with both of you and the police were unresponsive twice. Believe I would let him know I was in fear of my and my families life and wanted it on record as well as get his/her advice on how it should be handled. Then I would buy a 12ga shotgun just in case. I'm not the gun pulling type but you start pushing my wife around you have crossed a line.

To the OP, do you have dogs?

Since the people are unwelcome on your property and seem to think they can push you around (having done so, they have already crossed a line), I would start a home protection plan with some intelligent dogs, (trained). I would also get video up ASAP. And as others have noted, make calls to the next level of authority explaining what has happened. Perhaps send something to the authorities (certified). You need to start your defense and case, now.

But in this case, people are coming on the OP property and have by his own writing, threated him and his family.

I put in the link to the article as an example of what can happen when property rights are involved.

At this point - you need to step away from the little details like the potm and pulling post and stuff. You need to start putting up video game recorders that has a view of the said property but far away enough so there is no question its on your property so they wont see it and take it. If you start putting posts back up, make sure its not right on the properety line, but well inside your property and have game corder take pics of you doing that. when its taken down- court time. Do not confront anyone from this point on. It already got heated in the first place and you will have heated neighbors basically for the rest of the time you own that lot. Basically you need to cool down, use video surveillance with posted signs as your way to keep things on your side.

I understand about your want to use the lot, but you will need to have a surveyor out there and actually put in markers. Once the markers are in, you will need to have game cameras pointing to all of them if you can. If the markers gets pulled out, you have evidence since its illegal to remove the markers. Your only recourse for fast resolution is pictures and show the LEO's what you got and done so far.

The Gift of Fear great book btw. Cameras are a must, does your state have castle laws? at this point you have been threatened, hit by atvs, been attacked by mobs of people. I would think that pepper spray, at the least would be a must. A shotgun, would also be a good deterrent make sure the wife knows how to shoot also.

As Radioman suggests, step away for a monemt. One of the things that the Gift of Fear will help you with are your long-term goals. What do you want in the long-run, peaceful use of your property, or immediate retribution for the assaults? Going after the latter may impede the former goal.

Educate yourself. If you don't have a lot of experience in dealing with maggots, you might be making a mistake by exercising your rights on the short-term goals. I'm not trying to cover for lazy police, but that may be what the police see in the situation and you don't. They may know what you are in for with these maggots.

Only you can evaluate the people and decide the best course of action for you.

There are survey markers & the survey is current. The trespassers are the ones that picked the surveyor when this property was still part of the estate. They now claim the surveyor did not finsh the job & that the survey is wrong. It has only been a little over 2 years sinvw the survey. Their surveyor has already told them that it is correct.

All I am looking for is for them to stay off my property & leave me alone. I have better things to do besides wasting time dealing with them.

Again -- put cameras up when they are not looking. when you see them again or suspect they were there, get the pictures/video and call the LEO's. Document every step of the way what you done because if this blows up in your face, you have recourse. Eventually they will give up since most people dont like trouble from LEO's.

I think that pretty much sums up what the parties to a property line dispute always say. Hope it goes well for you.

It is like dealing with unwanted animals. Set trap, add bait, dispose of offenders. I'm sure they have paths they travel like animals. Pick one where they are coming good and far onto your land. Set something in the path that makes them mad/curious maybe find an old ford ranger for instance for a couple hundred dollars. Make sure to leave plenty of stuff in bed that they can vandalize with like paint, hammers you get the idea. Have game cam ready... oh yea leave a cooler of beer in bed iced down that is like kryptonite. As they steal and vandalize while posing for pics getting wasted, get your lawyer ready to sue them into oblivion. Maybe you will own some more ground :D
Your dealing with adolescent a holes. The only way to stop them is to:
-burn their little bank accounts down.
-find the ringleader and beat the he11 out of him (not real good idea)
-make their lives he11 in return when they are around. Make the cops just about live there.(it puts a damper on the mood)
