I had problems with one of my neighbors a few years ago. My neighbor thought part of my property was his. It can be very frustrating. After a while both sides had lawyers. I did spend $5k-$10K on legal fees. I haven’t totaled all the bills.

I like the game cameras or web cameras. I also like that you try to document what happens with photos or video and take it to the sheriff.

It was unfortunate that I had to spend the money to fight my neighbor. But in the end it was settled, we just ignore each other now, and I haven’t had more problems with that neighbor.

These don't always turn out for the worst case. I am hoping in the end this works out well for you.

In this case it isn't a question of where is the property line. It has been surveyed, the corners are marked and they are claiming to own the entire 19.5 acres that I just bought. Maybe this will bring them to their senses.

Please remind me (as I don't remember), do the PITA people "own" the neighboring land...or are they just being PITA people (who have USED the land)?

After they are served with the papers, there might be a little payback! Have a buddy that is laid off or on vacation? Dress him in a giley (SP) suit and have a very good video camera. Install him in the tree and do a little work close to it. Stick him in the tree early morning, tape the perpetrators, recording the conversation. Be polite, but firm in ordering them off YOUR property! ! No profanity or other threats, polite but civil. Let them escalate the situation. Get it all on tape, serve them papers again. Get a restraining order not allowing them within 50 or 100 yards of you or your wife and property.

In dealing with a situation where ancestral land is acquired by a non-family member, a strong emotional component may be driving the conduct of the "family". The tresspassers' frustration with the "legal system" that allowed the land to be "taken" from family members makes you the natural target of their frustration.

If primogeniture is also in play, the sense of outrage can be further elevated because the secular law didn't conform to the family's religious law beliefs. Never underestimate the ability of some people to justify breaking the secular law because they are acting under rights given by a "higher authority."

The people that I am dealing with were not family of or related to the person that they inherited the property from.

This property actually belonged to my great-grandfather. He bought the land in 1927 & it has been passed down to other family members until they came into the picture.

The same deputy responded to the chopper incident that responded to the first call. In the middle of him explaining how he couldn't do anything because he didn't see them a second deputy pulled up.

The second deputy asks a few questions, looks at the game camera pics & says send me all of the info that you have & I will take it to the county attorney on your behalf & request charges be filed. He said he couldn't make any promises but he would see what he could do to help.

The person that responds is makes a big difference in what gets done.
