Mahindra can't deliver my 5035 HST

Getting back to the original topic of this thread.
I recently bought a new Kioti. I asked for and negotiated a deal on a DK40Se. The dealer called me a week later and was having a problem getting the 40 in our area and asked would I take a DK45Se. I asked the difference in price and was $1500. Having already beat him up on the price of the 40 as much as possible he sold me the 45 for just $500 more than we negotiated on the 40.
I was happy with the deal and thought he treated me well. Here is the result.

I went to a Massey Ferguson August 2cnd looking for a GC1710. 2 weeks later i said I wanted it and told the dealer to get it. He also said 2-4 weeks. I called after that 11 occasions and he dodged my calls and wouldn't call back. Had wif call 5 more times and would't return calls. Last week I figured the deal was off and I should go somewhere else. So i stopped payment on the check and was ready to go to Kubota. The Massey CAME IN FRIDAY! I heard are sorts of apologies and reasons. I heard about pollution controls, customs, goverment shutdown, and other. I decided to buy the Massey after all.Same thing happend to my cousin on the small John Deere with loader. I'm just saying that I think this is how they all do business on these, unless they're in stock of course. I don't think this was unique to Mahindra or to your dealer!

I am glad everything worked out for you. However, the behavior you reference by the dealer shouldn't be the norm. I understand this is the internet age, but how hard is it to return a phone call?

Dave, I've never been to a counselor, or a therapist, but am guessing that the paint job was quite a bit less money. Besides, I'm improving, I haven't painted the 3215......yet. It sure would look nice blue though.

I like the paint ;)

Lol, Blue is my favorite tractor color, but red is my close 2nd, followed by yellow, white, orange, & green.

Glad it worked out for the OP ... too bad he didn't get his hydro, but PST is the next best thing. :applause:

My opinion.
A contract is a contract!

I think a lawyer would have fun with this.

quote: No, this discussion is about ordering (with deposit) something (be it a tractor or a VW bug) of a certain make/model. A contract is entered into. The purchaser has entered into it in good faith, the dealership has promised to deliver that make/model at an agreed price.

Yep. And if there is any doubt about availability the dealer should have called the supplier to do an inventory check. At least the OP good a great tractor anyway. B.

The dealer found him a tractor at another dealership and offered to go get it and sell it to him at the contracted price, but the customer wanted one "new out of the box". And the dealer-trade unit was new, never before sold, not a demo, etc. The customer rejected that option, which is fine, but we should not vilify the dealer in this circumstance.

This is not an issue of the dealer messing with the customer. It is just that the customer decided he would not take a dealer transfer. So before we talk attorneys and breaking contracts and that the dealership did not deal fairly...we should consider the facts.

Some people you cannot please.

I'd bail on the deal. Tell Mahindra to refund all our money and then never go back to them. If the dealer carries another brand of tractor, see if he has one you want and then buy it from him as he seems to have been dealing in good faith. Otherwise, seek elsewhere.
