You might want to consider that what you say here on TBN is subject to suit by manufacturers if they consider what you say to defame them or their reputation. This type of action is becoming more prevalent due to some consumers making statements in public forums on the net that manufacturers feel warrants scrutiny as to facts, not opinion. Unless one can prove in a court of law what one states is fact the manufacturer can sue for damages and likely win, due to their deep pockets and the desire to keep their business unharmed by false statements. Forewarned is forearmed.

Stating the facts of my woes with mahindra is not making false statements about mahindra. I hope my words do change minds about someone considering the purchase of a mahindra tractor and mahindra should loose business for the faulty products they make. This is how the free market works, word-of-mouth. I wish I had the funds and time to sue mahindra for the crappy product I am left dealing with. Every time the tractor breaks down I loose money. I loose money in productivity, time wasted taking it to the dealer, time getting it back home, and my gas $$ in between. Don't you consider the other side of the coin?

Does free speech mean you can slander someone or a company? There is a difference, for example, in saying someone is an arse than saying they are a crook. One is pure opinion, the other needs substantiation. I am all for free speech, and think everyone should be able to express themselves, even if they are racists, offensive and ignorant, it keeps the morons visible, but bashing a person's or company's reputation is unfair.

It's not slander, it's libel. Know the law. It wouldn't surprise me if mahindra tried to sue me; first sell me a tractor full of problems costing me $$, then take me to court for more $$ after I complain to others about my problems. That would make sense.

People have the right to know if others are having problems with their product, especially when it cost the consumer big $$ while they are out a tractor.

Get real mahindra huggers. I'll be loyal to a brand name when it's loyal back.

You did way more than state the facts. You showed a couple of issues you have had with your tractor and then called Mahindra a rip-off. The problems may well be facts, the conclusion you have drawn is merely you trying to get your pound of flesh because you did not get the solution you wanted. I think that is the part that is offensive to the Mahindra fans.

I have no reason to doubt your tractor is over-cooling and not coming up to temp. We have sold a few dozen of the 10 series and have seen that issue with one customer. We would probably see it with more customers but we are in a warm climate and most customers are working the tractors and they come up to temp fine in those applications. I think it is a legit complaint and the bypass hose and thermostat system needs to be revised so the tractor more quickly comes up to temp. An engine is not meant to run so cool, it really isn't good for it in the long run. So we are in agreement on the issue, just not your conclusion that Mahindra is a rip-off.

I respectfully suggest that life is short, sell the Mahindra and buy another brand and be happy.

OK, Libel, and as you say, know the law, Because you have a bad tractor, and I don't doubt you do, every Mahindra is faulty, or inferior and the company should go down in ashes? That is kind of like saying all Aliens are sexual perverts. We know all green men from Mars aren't all bad, right???? There are quite a few complaints about particular models on this forum, and they are legitimate, but don't be a moron and throw all the Mahindra tractors, or GM products, or BMW's etc under the bus. It is really a very ignorant call and you CAN be sued for it. Your ticked off, everyone gets it, LOUD AND CLEAR.

Poor you.:confused3: Somehow you have a persecution complex, Mahindra sold you a supposedly bogus defective tractor so you would be burdened by it and having to spend gas $$ to transport it to the dealer to have it fixed while under warranty?!
When one buys a tractor, car, truck, plane, whatever new it comes with a warranty and the warranty allows for remedy of manufacturing defects. It doesn't cover your time, transport, etc.
You're not happy with the remedy, sue the manufacturer, sell the tractor, trade it on a brand which will show 'loyalty to you' :confused2:. Just because there are problems with your tractor does not make Mahindra tractors a 'rip off'. That IS a false statement because it is untrue, and by making that statement you open yourself up to being held responsible for the damage it might do to their reputation.
It's not only false and misleading; it's your opinion, not fact, and you'd be hard pressed to prove it in a court of law.
Good luck finding the perfect tractor that won't have any issues, I don't care what other brand you choose; you need to adjust your expectations to the reality of the real world in which most of us live, and understand our part in any machinery ownership. All machines have issues, some more, some less. Mahindra doesn't hold itself up as being the perfect tractor, and it isn't, but it isn't the worst and it certainly isn't a rip off by any standard.
You're the one with the problem, not those who like their Mahindras.

With respect, I disagree with at least the sentiment of many of your assertions.

It defies logic to not acknowledge what the faults themselves are doing to Mahindra's reputation or that the relationship between buyer and dealer has broken down so much, the buyer feels possibly compelled to vent online. Unless the buyer is unreasonable or vindictive, the dealer has to bare some responsibility for this matter even being aired online. Can you be certain bbbmgo is the cause of their own perceived misfortune?

To my mind, it's not that a tractor has had faults. They all will. It's how they are dealt with that a dealer and brand earn or lose respect and trust.

CM, Opinions are NOT illegal. But, practicing law and giving legal advice without a license is illegal.
