There is something really wrong with this country when traspassers no longer have a right to a jury trial, and if trespassing supersedes right to life. Trespassing can be accidental, or visitation too. You fellas trivializing the use of guns on people are wrecking it for the rest of us, you're not much better than the inner city punks for that.

Please don't encourage folks to think that way. There are nutcases out there doing what you say, and the more you trivialize it the more it will happen. And your gov't HAS to act.

I was talking about having a gun on you as you approach a stranger who drives or walks onto your property, not shooting someone.

I've had dozens of people drive on and walk on my property armed. Usually hunters, but I had one person drive up with a hand gun on the passenger seat. I think I am within my rights to be armed on my property when I walk up to a trespasser. If I have a reason to have a gun on me and say I'm tracking a coyote it is less confrontational and they leave right away.

Yes, that is a problem. In another thread: jst's state is Maine. I don't know if he is a lawyer or just plays one on TBN. BUT from Who Pays Property Taxes on Right-of-Way Easements? | Finance - Zacks In Mississippi the ROW across my 70 acres is just for power company access. After some problems with dirt bikers and timber harvesters I called the telephone company and was told I could fence it off as long as they had access and could get a truck through.

Here in Ontario, the Hydro right-of-way is only for Hydro one, the Provincially owned power company, although the telephone company does piggyback their lines on to the same Hydro poles. No one else other than the landowner is allowed to use the right-of-way.

I'd start with a good gate, and some Private Drive signs. My dad lives at the end of a road, several people have driven right thru open field gates and into his hayfield before they realize something is wrong. Some just don't understand.

Others know better, dad had a neighbor that lives about half way down the road, so he knows it's a dead end road. He was always driving back and nibbing around. Dad said he once put up a game camera on a tree in the front yard, said he wanted to scout for deer. (He wasn't allowed to hunt on my Dad's land). If that camera would have been there while I was visiting, I would have owned it. Told Dad next time he put a camera up on your property, shoot it. This guy moved last year, but last weekend when I was visiting, he drove back and turned around, still nibbing around.

Dad had a few things stolen last year, including a chain saw. I have security cameras up now, which me and my brothers check when we visit. In his case, the road is public to his house.

We've one parcel of "family" land that has a deer feeder and game cameras set up on it by persons unknown. My BIL and SWMBO (an Attorney) are hesitant to do anything about it since the timber is just getting harvestable and an "accidental" forest fire would be costly. I wanted to confiscate the cameras and feeder.

It reads like your Dad needs some IP security cams that send pictures on detection of movement.

cameras are recording. My experience with sending pics on movement, is that you can get thousands of pics a day, it's just not practical.

Cheapest is a sign. Various ones suggested.

We put in a $4,500 12v-actuated-solar-charged gate. People would often just drive in.

Before this, we had a driveway alarm. It was mainly a help to know when someone expected had arrived. Not much help for others unless you wanted to carry around a baby alarm (with sender beside the alarm receiver in the house) with you while you worked.

We still have the driveway alarm ahead of the gate so we know when anyone expected has arrived. Then we know to step outside with a driveway opener when it goes off, if we haven't given them a gate code.

My lane 1/2 mile. One dusk evening coming home a person driving out about 1/2 way point. I stopped side by side. His windows were down.; 2 people. I said what you doing? they started mouthing off. I showed a revolver. The guy takes off and in his haste his front fender caught my front bumper. His fender was tore off
and he kept going. State police came. After taking info I said you taking evidence (fender) ? He said, you keep it and our best chance of catching him is for you to
watch for car same color with no fender. Then you call us.

No I'm not a lawyer... nor did I deserve that commment. If I were it would need a lot more that this post to point out the difference between owned (fee) land and easements... The difference between getting permission to put up gate/signs to control access to somebody else's land and just posting it because you want to be the only person who trespasses there...

the gate works better than a cable / rope across it. ((rope / cable = dangerous to your own vehicles do to not being able to see it, learned the hard way))

gate is very light weight. and does not drag in snow/mud on bottom. and you don't get a large snow drift on or around the gate.

there is also "counter weight gates" that swing up and into the air. but you need some space on each side of gate for the counter weight.

i really do not like "swinging gates" due to walk back and forth to get them to close but are cheap. when you get into livestock gates. were you need something going clear across the bottom. i have picked up boat trailer jacks (they tend to have a caster wheel on the bottom of them) so i can #1 able to easily crank up gate if i need to, to get bottom out of snow / mud (big issue for me), #2 after so many years a gate will more likely sag down. and the jack lets me adjust the gate easily and helps prevent sagging long term, due to the hings on post are not holding all the weight clear out there in the center when the gate is closed.

be careful with no trespassing signs. there are rules / regs here in Illinois that they need to spaced every so many feet along property. (not kidding) and simply having them at entrance/exits is not good enough. i hate dealing with signs. due to wind / hail normally tears them up pretty good. it is not a simple go nail a sign on a post / tree and expect them to last for years to come *big frown*

electrical, water, gas, and like companies DUE need to get to there meters to read them. (no if ands or buts about it) and most likely there is some lawyer speak in documents you signed for there service of them coming on property to gain access.

I didn't mean to insult you, is being a lawyer an insult? But I couldn't quickly look up the laws for the State of Main ROW's.

You seemed to imply that the ROW was OWNED by the power company. That may be IN YOUR STATE. It's not where I am.
