325F.6653 - 215 Minnesota Statutes MANUFACTURER'S DUTY TO REPAIR.
If a farm tractor does not conform to applicable express written warranties and the consumer reports the nonconformity to the manufacturer and its authorized dealer during the term of the express written warranties or during the period of one year following the date of the original delivery of the farm tractor to the consumer, whichever is earlier, the manufacturer or its authorized dealers shall make the repairs necessary to make the farm tractor conform to the express written warranties, notwithstanding that the repairs are made after the expiration of the warranty term or the one-year period. For a self-propelled vehicle this section is limited to warranties on the engine and power train.

I don't see a link as necessary. She's not asking for our opinions about what's wrong with the tractor. She's asking for any experience based opinions about how to negotiate out of this tractor. Nothing to do with the mechanics of it all.

And she's being very, very patient with us. :)

Yup. I think I got a "lemon" . I could go all "geeky" now, 'cause I used to be Six Sigma certified. A six sigma process is one in which 99.99966% of all opportunities to produce some feature of a part are statistically expected to be free of defects - and I managed to get the one tractor that was .00035% and thus defective. Good company; good technicians, good service but the tractor is still a lemon. Now we start negotiating.

Yep, I believe you did get the rare lemon. Sorry I don't have great words of negotiation wisdom for you.

Lemon laws pertaining to the number of times a tractor has had an issue with the SAME thing. Only knowing that the tractor has been to the dealer multiple times doesn't make it a lemon. Multiple times for the SAME thing may qualify. So knowing what the issue(s) have been and if they are related are key pieces of information

My state requires the manufacturing defect to substantially affect the use and/or value and/or safety and the item must be covered under the new vehicle warranty... as an arbitrator, I do not have to decide as eligibility has been decided before I receive the case.

Documentation and presentation is the key...

Documentation to prove the defect(s) exist and the manufacturer has had the opportunity to repair.

Presentation in that you are willing to escalate to see the issue resolved.

Sometimes it takes filing to get the attention of someone that can resolve the issue.

As always... you must state your expectation for resolution... a replacement, refund, extended warranty, reimbursement for past expenses...

It is important to point out business users do not have the same protections here as end use consumers... so a homeowner with a riding lawn mower may be eligible whereas as landscaper would not.

One more thing... Magnuson Moss Warranty act provides the warranty is automatically extended for the period of time an item is out of service for warranty work.

It will take persistence to see it through and some simply give up.
