Mahindra MPOW85 has no power, bought New:

Tractor has been at the dealer numerous times. I had it put on Dyno at local JD dealer(twice). PTO hp is 61-64. When I have complained to Mahindra Customer Service and to dealer about the hp, the Customer service said that advertised HP is Motor HP, Not PTO horsepower.
If i am pushing snow and the rpm's are at 1000 it will not speed up when you give it throttle, it will just back off instead. Must have it over 1000-1200 rpms to have any power at all to push snow. Temperature outside is at 30-40 degrees when using it. it is not a fuel issue.
The dealer did a complete oil and fuel change at 50 hours, and it has not improved the power at all.

If it's financed you can always have them come and pick it up and tell them you'll start making payments again once it's returned to you and performing up to spec. Till then, not another dime.
I see they sell this model with a diagnostic computer option, it's an odd thing if the dealer hasn't bothered to hook one up yet.

Well in this state anything they have a thing called a lemon law. He's surly met the criteria for that already if his state has one. I think once they get the idea they might actually wind up standing in front of a judge, they'll get their backsides in gear and get it taken care of the way they should. Remember, if he's still holding the money, he's holding the long end of the stick. Financing if any is though Mahindra not the dealer but probably the finance is really with some bank or other financial institution. It's time to put the pressure on though the money chain if there is one. No one expects people to pay for something and not get what they pay for and they know that too. In the end the only loser here can be the dealer. If they are a lousy dealer, Mahindra doesn't want to lose on their account. Selling one tractor at the cost of losing three simply isn't good business practice that will stand the test of time. They know that too. The squeaky wheel gets the grease but if you choose to suffer in silence you'll simply suffer alone.

Granted the tractor appears to be a little low on PTO hp, he was pushing snow at 1000 rpm and expects it to speed up instantly when he gives it more throttle. He needs to raise his rpm some and his problem goes away.

A little heavier foot will correct this so called problem.... or just roll around and throw a fit when something doesn't go your way... lemon law it is I guess

And in the defense of the OP, the newer diesels do not rev as fast from lower rpms, especially with a load. The older diesels would pour on the fuel and gain the rpm quicker I believe, and roll a little coal out the exhaust pipe doing so. Emissions requirements do not allow for that anymore. Combine that with a heavy tractor and running way too low rpm, and it will sure feel sluggish. As many have said, raise the rpm significantly and lower the gear and the tractor will push snow, and a snow bank, and a car in the snow bank, and the tree behind it. This is a strong machine, but not at idle.

Foster, your advice on lemon law would not apply if an operator was not running the tractor correctly, and I think you are thinking about consumer protection for autos anyway. And the finance arm and the sales arm of Mahindra are two distinct companies and not making payments is a poor idea. There are better ways to get attention if a problem persists.

I know if I were being ignored, I wouldn't continue to pay for something that didn't work, it was still under warranty and they can not or will not fix it. You'll be my first call when I want to sell some junk that doesn't work. However, I think you may be out of touch. If it's his problem then fine, it's in his court and he's on the hook I have no issue with that. However if it's their problem and they are not taking care of it it's in their court. These days the courts have a rather dim view of poor service or products not performing as they should when new. At the end of the day, it's seen as a simple contract in any court in this country, lemon law or not. Now I'm not talking about spilling hot coffee in my lap, I'm talking about paying for something and not getting it if this is indeed the case.
A contract, any contract, goes both ways. In this case you're contracted to pay for and receive something and financing if any is a legal and binding part of that contract for both parties, it is not separate nor does it stand alone.
At the least I would diligently document all communications with the dealer regarding the issue and let them know that I was doing so. I would also let Mahindra know. I surely would not hunker down, take a screwing and pay anyway.

BTW Not that I care but my credit rating is probably higher than Donald Trump's and I've always played hardball with stuff like this.
