Co-worker bought a house and lot in Owen Sound . In the dry summer time He did not notice the 18" grated storm drain culvert at the back of the property On out to a grated storm drain at the curb.
A few weeks later there was a torrent of water running the length of his lot along the property line and part way over to the house . Not a cloud in the sky, the municipality was flushing fire hydrants in the next subdivision over .
The house is considered to be in a flood plain and the yard is seasonal fish habitat. Jurisdiction belongs to Owen Sound, Grey County, Saugeen Conservation Authority , possibly the MNR plus the department of oceans and fisheries depending on who you ask and when.
Can't get a straight answer and the problem according to what ever bureaucrats asked is due to another organization. They all have no problem however collecting taxes, fees and enforcing rules or regulations that prohibit burrying an underground culvert the length of the lot.

It seems if you work for the government in Canada, you can do no wrong. Just pass it along to the next department.

Then there are many that build alongside a major highway and demand 'noise abatement walls', naturally at gov't expense.
OR
Building on the approach pattern of a 75 yr old airport and have aircraft diverted due to noise.

Want hydro to run lines underground because they are ugly

As a rule title insurance won't cover anything a current survey will disclose. They also won't cover anything that isn't a public record. My understanding is in the OP's case, title insurance isn't going to help.

I got a call from a tenant 2 or 3 years ago asking me why didnt they tell me a new septic was being installed ? I told them I am not getting one installed . So I go over and the lady next door was getting one done . But the backhoe operator had 1 drainfield done and was half way thru his second , about 150 ft total . So I am there and walk up to him and he first goes off telling me the area is dangerous and he doesnt like spectators . S I take some pics while I am there , and he yells to get off his jobsite . So I tell him " do you want the bad news now , or should I let you finish what you are doing ? " What bad news? Well , first dont even yell at me again , second you are tresspassing on MY property , so you just wasted a day and lots of stone digging in the wrong place . So the guy says BS and grabs his plans . He shows me , and I show him , " Hey see these lines , you are looking at the plans reversed " The look on his face was priceless . I then tell him , Now grade my lawn properly , I will have my guy bring in topsoil , and hydroseed , I will send you a bill . He tells me he can do all that , and wont pay me for what he can do . So I say let me call the inspector for the county . I had a check that day

Not me but this is what happened to some very close friends. The wife (the couple had not yet met nor married) bought a house. Turned out that the house would flood in a heavy rain. The lady met a guy and they eventually married. During some of the heavier rains, the manholes would actually blow out of their housings. They would open a rear garage door to allow the water to flow into the garage door and out the man door.

Turned out that a corrupt city official had signed off on building that house where a drain area was supposed to be. It took ten years and a divorce sadly to say but the city did settle.

The settlement was enough to pay off the house and pocket the money lost but no more never mind the divorce. They had been a great couple but the stress of it all just spoiled everything.

My brother owned a 1930s house on a city lot. Vacant lots on either side. Someone bought one of the vacant lots and discovered his drain field on their property. He owned the house probably 10 years at the time and had no idea the field was there. Total replacement on his dime.

Fortunately a friend of ours was a plumber so he dug the new field and a bunch of friends did the labor so cost was much better than it could have been.

The city will lawyer up and beat you down with your own tax dollars. Not a fair fight. If you do get a lawyer to represent you he will hang around until your money is gone. Figure it out.
