So, how are you going to access the build site AFTER you are done? What are you building? Barn? House? you need to think long term about this. What if that old bridge gives out? What if your agreeable neighbor is replaced by someone not so friendly? You are potentially opening up a can of worms here. Finding another permanent route or buying some of your neighbors land are both solid ideas. Consulting with an experienced real estate attorney is also not a bad idea. I am a surveyor who specializes in right-of-way, trust me things can get weird in unexpected ways if you don't think things through.

It is possible that the old road still has a viable easement. Have your attorney check into that. It may even already be attached to your neighbor's deed. If it is on the books as a public road you may not want to open it.

My thought...

if you plan on representing yourself writing up a legal document pertaining to a easement that you think you can just change later becuase you need it signed soon so you can get to work on it, there is saying which slips my mind about being a fool representing yourself in the legal system, which I believe applies here.

Long story short, whever you see "easement" or "homeowners association, run the other way and never become a part of it, because sooner or later, it's going to become a REAL PITA.

I granted the city an easement to cross my property with a sewer line; I was in law school at the time and thought that it was no big deal. I lived to regret it...there is always something that you didn't think of at the time; an attorney versed in property law would be a wise investment on your part. I can see all sorts of things you might need to consider; such as water rights, drainage easements, the right to alter to say add a culvert or a bridge of your own; fencing, etc.

Easements get tricky. Took us about a year to get everything straight so we could get a construction loan. It will need to be surveyed, recorded etc. Do you really want to do that yourself?
