Stupid workplace safety rules

Since we have been acquired it is ALL on company time... the difference from being a community based stand alone facility and one in a 100,000 employee organization is mind boggling...

When asked... I was told a lot of the mandatory instruction has come about as the result of lawsuits and fines and crafted by lawyers to protect the company...

I have found several instances where the module does not apply, is out of date or flat out wrong and mentioned it... the reaction has been just complete as assigned... no interest in re-hashing or updating from the bottom up... there are consultants and the legal team that decide from the top down.

It's all just legal butt-covering. Simply so the next time they get sued they can say "see, we tried". Either that, or just complying with a prior lawsuit that mandated that they do XYZ to avoid it in the future. Mostly not pertinent or useful stuff. Lawyers justifying their existence.

I filed a formal complaint with HR. The module was on harassment, so I felt well versed. I'll let you know how it goes.

I'm working on this BS Rules Requirement as I type this. I just received a WARNING, that I'm not taking LONG ENOUGH to go through the work. This is despite the fact that I've answered every question correctly!

Why is it that we have to all achieve the lowest common denominator in order to move forward!

Years ago I hauled flatbed freight out of Canada to points along I-5. At one of the border brokerage offices in Blaine they 2 signs posted on the wall behind the (mostly female) clerks who typed up the paperwork needed to clear customs. The first read "WARNING: SEXUAL HARASSMENT WILL not BE REPORTED, however, it will be Graded."

The second sign was brilliant in its truthfulness. "Everyone brings joy to this office, some when they enter, others when they leave."

The women had to be thick skinned because too many truck drivers were too thick headed to understand the limits of decency and courtesy.

I didn't make it. So I sent an email to my HR department with a harassment complaint concerning its assumption as to my inability to perform at my ability. I requested a formal assessment concerning this module's harassment of my feelings and ability to read, comprehend, and respond.

Wow. That's a new one. We have periodic online "training" programs as well at our work. Many people blow through them as fast as possible by just clicking next as soon as you can until you hit some quiz midway or at the end. They tell you the time you took, but it never says you were too fast or too slow. We have kinda wondered if they would do something like that in the future. One of our training systems does have a timer so you can't click next immediately when the page comes up, but they are usually only a couple seconds or so.

I read something in print recently, on a related topic. I thought it summed things up well....

"In the past, common sense was expected and appreciated. Now it is criminalized."

I have to take a variety of continuing education and education classes via a couple of different websites.

One website penalizes you for being a fast reader and forces you to spend a certain amount of time on each page/section. Sooo, what everyone does is start the page/section and then go do something else to let the timer pass THEN read and go to the next page/section. The problem with this stupidity is that one looses the continuity of reading at ones own pace. Just flat out dumb.

Another website requires a X hours to take the class. The time starts when you take a test on the content you are about to take. Once the pretest is done the clock has started so I take the pretest and come back a week or so later and finish the class at my own pace. The %^&*() frustrating thing is that sometimes I have NOT done this, did the pretest, then the class, gotten 100% but I had failed to spent the X amount of time so I had to do the test again. :confused3::shocked::eek::mad::mad::mad: STUPID STUPID STUPID.

What makes it even more idiotic is that some of these classes we have to take every year. Frankly, if I can't pass the pretest after all of these years, I should not be working that position. I SHOULD pass the class on the pretest and it SHOULD not take any time.

So much of this is lawyer driven as well.

I just read that Disney is going to inspect every room at their resorts each day. The Do Not Disturb signs have been replaced with Occupied or some such. This is an obvious knee jerk reaction to what happened in Las Vegas and is a result of lawyers. If someone wants to repeat Las Vegas at Disney, they will just fill up the room when they arrive or the day they wish to start the attack. The maid "inspecting" the room is not going to stop an event.

Furthermore this just means there will be more thefts from the staff. It also implies that the staff will be search rooms, drawers, and suitcases. If not, what is the point? If they are going to do this, I can see the lawsuits happening.

For years now, Disney has been searching bags, back packs, strollers, etc when one enters the parks which has caused huge lines and masses of people waiting in line for the search. Kinda ironic that the searches have made people MORE vulnerable to attack. This year, to make it "safer," Disney added metal detectors so there are now two security lines one has to pass through before finally getting into a final line to get into the park. What the three lines have done is made for a huge mass of people contained in small areas at the entrance to each park. This is such an obvious target...

The best spin I can put on this is that Disney has done the math and figure that an attack in the mass of people at the entrance would result in less casualties than a bomb on a ride such as space mountain. :confused3: Certainly the blast will be out in the open vs confined which should minimize losses but I really wonder. I can easily think of ways to make that assumption false.

Tower of Terror does not scare me, well not much,:laughing::laughing: but standing in the mass of people waiting to get into the park makes me more the nervous.

But Disney's lawyers can say hey we tried.

Speaking to our HR manager (who gets quite frustrated with all the PC) about a managerial role that is coming up, he told me that I wouldn't qualify due to lack of education, eyebrows raised a little I asked what he meant, to apply you have to meet the criteria set out which is a High School graduation (we call it HSC) followed by a relevant tertiary qualification.
I never did the HSC as I went to trade school before the exam year as did a lot of people my age so that puts me out of the running, the fact that I hold a BA, MA and Phd is negated by the lack of a the first, it is a ridiculous situation and happily I am not looking for work but I feel for a suitably qualified person who would fit in well but cannot apply.

In a similar situation here, there was a gal with a community college degree working with a bunch of 4 year engineering graduates and doing everything they did and did it well. However, they would not promote her beyond "aide" because she did not have a 4 year degree. Didn't matter what her abilities were or what she was doing - that piece of paper (whose value might be questioned) kept her back.

Resistance is "Almost" futile...

You will conform and as long as you check the boxes and do what is expected you have covered yourself... that is until the entire firm or enterprise is no longer viable.

Middle managers are really there to make sure the masses comply.

My facility posted a safety notice stating county public Health Nurse requires the flue vaccine each year... and to make sure you get it sign up or submit proof from your physician.

It goes on to say vendors and related services must also have it.

Well, I made an appointment with the county Public Health Nurse who was gracious enough to see me and said it is "Recommendation... not a mandate..." interesting how things get twisted.

When I was approached for non-compliance I mentioned I met with the County Public Health Nurse who said there is no such requirement and presented his business card and said to call should HR have any questions... let's just say it did not go over well.

Technically, it is also voluntary in that you sign a consent form that you have been advised of possible adverse affects.. to give informed consent you must be provided with the FDA literature... which also was not available.

This year the efficacy is below 10%... not withstanding should you have an adverse reaction it is not a worker's comp case, nor can you sue the manufacturer or employer as both have full immunity... only recourse is to make a claim against a Federal Fund that has paid out millions.
