Sister was a PVA in another county for years, things like this can get completely out of hand. You should have stopped it years ago.

I think that he knows all of that. It sounds like his neighbor has some influence, hopefully that isn't why the Surveyor has pushed the date back.

I would not do that. This type of person would just start using the next 25 feet (or whatever it was). There are takers and there are givers in life and this guy is a taker.

The "neighbor" is supposed to know he is trespassing...I would like to hear what he has to say about his actions... does he admit to trespassing??....or is there more??...there is always at least two sides to every story...!

I've been asking my grape farming neighbor to stop running his tractors, trucks, cars, wagons, sprayers, etc. on my property to tend his grape rows for seven years now. To no avail, so this year I posted the property and put t-posts up to block the equipment. He has pulled up the posts and signs twice now throwing them into my field. I had the county sheriff talk to him and he keeps doing whatever he wants. Property line is not in dispute. He just doesn't care. Inconsistently says you can come on my property and next time says stay off and the says he doesn't care if I hunt his property. So unsure how stable this guy is. The grape row ends are 1 foot from his chosen line.

During questioning about this problem I was asked why isn't the property surveyed? Well, it will be next week. But the neighbor walked the line with me seven years ago and told me where the line is and I said I wasn't sure. So the grapes, a recently dug drainage ditch and signs are all on his side but his equipment runs on my side. Things are starting to heat up and not sure where to go from here. I think a fence will be run down. I'm thinking of my own deep as I can drainage ditch after the official survey.

Maybe here is something not suggested yet.

You might consider building a financial case against the neighbor. If I were to do this, I would decide upon a land lease fee chargeable on a monthly basis. It's your land-- you can choose the amount. Then calculate a pro-rated amount of property tax. And a calculation to restore the land to original condition when the lease is done. And a fee for periodic monitoring of the area. Plus I would contact your insurance company to ask about additional coverage necessary to cover a 3rd party running equipment on your land. $2M in liability coverage out to do it.

With all of those added up, I would approach the neighbor with an offer to lease. Present the monthly cost, which starts TODAY. Ask the neighbor to sign a lease and a waiver of liability. And provide proof of their own insurance and have him add your name as an additional insured on their policy.

The chances of your neighbor signing this is, of course, low. But, you are building a very strong and verifiable case for future collection of damages. I would have your presentation witnessed or send it certified mail. And I would follow up, each month, with another statement detailing how much is owed, plus collection charges of course.

If you have to press your case in court, you then have some excellent documentation to work from. If this ever went in front of a judge, I presume the decision would be very favorable for you-- if all of us know all of the key facts based on just hearing your side.
