Law Enforcement must vary a lot...

Live in a city of 450,000 and very much on your own... car stolen, home burglary, etc... citizens are directed to file report online... no police response.

If you report child endangerment, domestic violence, anything with a gun or in progress police respond... just not after the fact.

Property line, trash dumping, etc... simply don't rate a response.

Thief dumped a brand new stolen mustang on the folks property... call law enforcement to report... no one showed up until 24 hours later and then only after many calls... simply said it was a private property tow... since no crime in progress.

That's what the OP suggested in post #1.
May not be a bad idea, but in some jurisdictions you just can't go digging drainage ditches without permits, etc. and there might be liability if someone fell in the ditch and was injured. I would try to follow an attorney's advice.

That is a complete misstatement.

Both the OP AND the neighbor are in complete agreement on where the property boundary is located. The neighbor KNOWS he's trespassing, he just doesn't care.

The ONLY thing the survey will do is to give legal ammunition to the OP's new lawyer, so he can then drain the OP's pocket book during a likely YEARS LONG legal battle with the neighbor, to try to get him to stop doing something he already KNOWS he shouldn't be doing in the first place.

To each their own.

If he doesn't have a survey, how does he really know where the property line is??????? He, the neighbor, and you, can all assume it, but until there's a survey, it's only an assumption. Best to get it legally recorded, then fence it in once and for all and be done with it.

it sounds like you live in a very bad area.. was that in Salzburg Austria?. because I think most members here wouldn't have a clue as to how things work over there!.. but in New York, which is in the U.S.A., if the Police are called, they Will respond!.. especially for a Misdemeanor or Felony.. trespassing on a fenced in property is a class B Misdemeanor here in New York.. but, you either have to see it happen, or have pictures.. a trail cam, let's say inside a pumpkin well out of the area that the trespasser trespasses on would do the trick.. photo evidence is enough.. as a matter of fact, Police here even enforce noise ordinances, which are Civil!!..(fine).. I think the problem the OP had, was he didn't have a fence up!.. btw, destroying or stealing a fence is also a Misdemeanor!!..

I am pretty sure he was referring to the Oakland CA area, where he currently lives and works...

we all have those idiots. When I sold in the city and moved to the farm last yr. Had the property surveyed. About 2 months ago the guy behind me says '' the person that surveyed your property placed the survey stake 10' on my property''. I said ''ok lets see your survey and we'll try to see if there's anything wrong I'll call get my survey man back''.
This idiot says ''Oh, I don't need a survey, I measured the line with my measuring tape''. I laugh and tell him to get himself a survey and get back with me. He says '' I don't need a survey, I'm that good with a tape measure''
At that point, I laugh at him and say '' If you want, we'll go to court, I'll have my survey there and you can tell the judge you don't need a survey that you use a measuring tape''

I started putting a fence (6x6 post cemented 4' in the ground) up on that property line. He came out while I was working on the fence. I told him '' unless you have a survey, I have nothing else to discuss with him.'' He went back to his house and I haven't heard from him since.

normally without the neighbors permission, a fence has to be 6" off the line.

A lot of this stuff varies state to state. Fence 6" off the line? I'd like to see the law on that. As far as I know you can build the fence on the line although some cities will have zoning that might say otherwise.

Its called right of entry for surveyors to go on another persons property other than the person they are working for. I work in Illinois and we have right of entry. No notice is required. Some states require notice. Other states you have to ask permission and they can say no.
