In Virginia, you can not say a particular truck did it,,
what is stopping you from getting a plate number off a truck sitting in Hardee's while the driver is having a burger?

I once lodged a complaint against two beer vendor drivers who were driving side by side down the highway for about 8-9 miles at 30MPH under the speed limit . I gave time, date, truck number, and location; all information that you can't get from a parking lot.
If I'd had a passenger I would have had a few pictures, including that of the pickup passing in the breakdown lane; and walked into the commercial State Police barracks with my complaint.

If a stone comes off the road on their tire and hits your vehicle, tough luck. If it falls OFF of their truck and hits your vehicle or breaks your windshield, they are indeed liable. I've collected two times by telling my insurance company the license number or truck name and all the particulars. They contact the other insurance company and "mediate" it and I get my windshield replaced. That's how it works in Ohio. The other driver, or their insurance company, does indeed pay.

Good to know for the next time I get a rock chip. Some of those trucks have bedcovers but do not use them.

How many cameras do you need to capture the image of the rock falling off the truck, then follow the rock to the windshield as it bounces several times before striking the car, then be no focus on the windshield when it breaks, then there will be a number of cameras required to video the entire windshield,,,

Then, you will need more cameras to video the grill should the rock puncture the radiator or air conditioning coil,,

it may be helpful to have some of the cameras mounted on the truck that the rock is falling off of,,,

You probably need a "Google-Type" roof mounted cam to prove there were no other trucks in the vicinity that the rock could have dropped off of,,, :confused2:

I'm curious how that works in "no-fault" states such as Massachusetts and New York.

Me too. I just don’t know anything about the no fault laws in other states. We don’t have it here.

Not needed. The sworn testimony of a credible witness, even the plaintiff, if found credible by the finder of fact can provide the necessary preponderance of evidence to prevail in a civil case for damages.
