Neighbor has elected to damage over 20 trees

How many property owners are involved who would have a say in the road maintenance covenant?

There is 10 property owners. But only us and the neighbor live here fulltime.

No you don't fully understand ! Yes...work can be done within the ROW but only with permission from all the other land owners...you just can't arbitrarily start clearing land and cutting trees down.

So does the guy in question actually need the wider road to get into his property?

Good thing he didn’t come into YOUR property. All the election, yard sale, and real estate signs on the ROW by my property don’t seem to get put back when I mow but past that there’s nothing I can do.

In Texas, probably most states, those signs can’t be legally placed in the ROW of a public road.

That should make it real simple. Contact the other 8 and see how many give a flip as much as you do about it. If they don’t then you probably should drop it.

I will throw one more 'nugget' into this. Across the road on another property, within the ROW the owner had built a 60' long by 2' high x 3' wide stone wall dry layed. Well that stone wall is now gone and added to the neighbors property as well. The rock wall owner was never notified or asked by the neighbor if he could take it. Yes, the road is smoother now. But my point is he did all this without asking input from the other property owners. How do you get through to this neighbor that all he has to do is ask permission by the rule of the 'covenants' ? We are afraid he will just keep on doing what he has been doing.
