In part the problem exists because many of the people that bought in the area bought thinking my family land is open space or parkland... I have been to open houses and heard the Broker say that verbatim... how the view is protected as it is all city owned land....
The HOA had a motion to spend a ton of money cleaning and clearing the trails... when the estimates came in it was quashed... glad of it too... as I have one of the few lots where the trail bisects my property instead of running down a property line...
Whether or not the details came out in bits and pieces or whatever, there was a lot of good dialog and I think many learned something about ROW and easements, I know I did. I travel across 4 parcels on an easement to get to my house every day and on my rental about 20 homeowners cross my parcel on an easement. So I saw it as good dialog worth learning from. Also there are different laws in different states which could have been confusing things somewhat.
