Whether or not the details came out in bits and pieces or whatever, there was a lot of good dialog and I think many learned something about ROW and easements, I know I did. I travel across 4 parcels on an easement to get to my house every day and on my rental about 20 homeowners cross my parcel on an easement. So I saw it as good dialog worth learning from. Also there are different laws in different states which could have been confusing things somewhat.

Yep... good to know what could and might happen...

I have property with easements running through it and it could be a problem someday as one is a dedicated equestrian trail... thing is NO ONE has horses around here be when it was laid out back in the 1940's it was for horse people...

The HOA had a motion to spend a ton of money cleaning and clearing the trails... when the estimates came in it was quashed... glad of it too... as I have one of the few lots where the trail bisects my property instead of running down a property line...

In Washington... I travel over two parcels to reach mine... both neighbors are great... one I see often... and is most grateful for any assistance... the other is basically a recluse with little more than a wave... which is good too...

I've been told that I may have a problem someday if I were to sell because a lender might require a formal agreement... cross that bridge when I the time comes or I may never if I die first.

I just did a quick look at the easement where I live. :reading: In a 1955 document I found simple permission for ingress and egress providing no damage was done to the 12 foot road. That is all I thought that I had. Later it was enhanced and recorded at the county to a 35 foot easement for ingress, egress and utilities which was buried in my purchase documents. Utilities come accross from the neighboring place so they do not even use the easement. Yippee! Should I get the chainsaw and tractor out? Some of the trees are about 5 foot in diameter, firewood for 10 years..... I think not, I would rather get along with my neighbors ... :silly: :silly:

A lot of getting along has to do with courtesy and respect with a fall back of knowing exactly where you stand.

With most things in life there is an easy and hard way to do things.

When I first bought my D3 it was to clean up and put in fire trails/breaks... that first year I had several visits from the police department and city officials...

I was as nice as could be and said I really didn't want to be out here either... had better things to do but the Fire Marshall sent notice stating the fire ordinance requires fire breaks and fire trails due to size of acreage...

Even asked the Sargent that was called out if he could give me his business card stating I need to stop what I was doing...

In part the problem exists because many of the people that bought in the area bought thinking my family land is open space or parkland... I have been to open houses and heard the Broker say that verbatim... how the view is protected as it is all city owned land...

The experience has provided good practice in diplomacy and getting along with people... after all, property owners can very vulnerable in that you can't exactly pack up your property and move... so you have more at stake.

Amazing. I have similar problems. —- Oh, is this private property? We thought it would be a good place to go for a walk——— Uh,,, you climbed over a fence, yes it is private property.

Speaking of ROW's. Not long ago we had 4 power outages all on one windy day. I called the power company and said "what the he77". They said tree trimmers are coming very soon. A few days later a trim crew with several bucket trucks and a bunch of men arrived in the area. And boy did they start cutting. Any tree whose foliage was 15 feet from the line got killed. Dead. Cut to the ground. I don't know how many trees I lost in the ravine, but they were mostly "peckerpoles" of the sycamore variety. But I did lose 3 trees in the yard, and a bunch more cut back.

Many people were angry. One lady sicked the dogs on the crew. The more I though about it, the calmer I became. You know what? They are just stupid trees and they run a risk of falling into a power line. In fact I had another large tree leaning over my road away from the power line so they left it, but I went out with $150 and asked them to cut it down and cut it up, and grind the brush and stack the wood. They did.

The wife went out with a plate of brownies, and asked for all of the mulch. They started dumping all of the mulch on our "mulch pile area". We probably got $2000 worth of chips if you had to buy them. A huge mountain. Win Win.

Yeah, it left me with 3 stumps in the yard to mow around, but I used to have to mow around the dang trees anyway. I got rid of a tree I had been worried about anyway. and lots of tree trimming. Overall, a good deal. Oh, we haven't lost power since. :)
