There is 16 individual lots. But only 10 owners. We own 6 of the lots the neighbor owns 2 lots. That leaves 8 lots with 8 owners.

So you, and a combination of either two or three other owners, can control the POA by majority vote. Reminds me of when I built the 11th house in a 105 or so lot subdivision in 1998. The developer controlled the POA for three or 4 years, because he still owned the majority of lots during that time. Sold and got out of that mess in 2013. I NEVER will again buy where there is a POA or even a possibility of one.

But didn’t you at one time say that an owner got a vote for each lot he owned? How many votes are there among the 10 owners?

I still contend that the road just needs to be in the easement, not centered on it. I'd have to read the deed and the covenants to be sure. How close would it have to be? If its one inch off? Two inches off? 5' off? Courts have shown in past rulings they are not concerned with trivial differences in distances. Of course the question is what is a trivial difference.
