Again there is no way I will ever buy another piece of property that would fall under a HOA!

--------------------------------- As somebody previously mentioned those people work for you, not vice versa.
And there lies the problem. H.O.A. board members are elected by all the home owners in the association. The majority of home owners get what they voted for, the rest have to live with it or sell out and move on. No different than local public municipalities' elections, rules, and regulations. So the elected board members and officers are working for some while at the same time working against others. :confused3:

Myself, I value my freedom to do whatever I want on my own rural property, within reason of course, too much. My family and I would not ever consider living within the constraints of a H.O.A. regardless of any perceived perks. ;)

my Experience and that of most I knew that had problems with a HOA were not because they worked for the majority but rather they worked for just the few that they golfed with at the local country club!

They hide thier true agenda till thier numbers are right then they step all over the ones they are there to work for in the name of the few!

When we searched for a new home there were 3 dealbreakers.
Private roads
HOAs
Easements.
I would not consider any, period.

I would recommend adding MUD´s to that list. MUD = Municipal Utility District

That's BS. Even a town can't pass new zoning ordinances outlawing preexisting uses, for the very reason that you cite.
If an HOA is not attached to the deed it is voluntary and takes the teeth away from an HOA. They can only in force local ordinances.

If it's attached to the deed then they have teeth and can enforce what ever they decide.

When I lived and worked in Florida, I saw both types and some neighborhoods that were pretty extreme. Definitely a buyer beware market and do your due diligence before buying in a certain area, county, or neighborhood.

Translation: my mind is made up, don't confuse me with the facts.
I can see how the can make sense in a suburban neighborhood, or at a condo complex. Everything is fine as long as everyone is considerate of their neighbors, trouble is, there are that few jerks who ruin it for everyone. Out in the sticks where your nearest neighbor is a half mile away, not a big deal if he has junk cars in his yard. Way different when your houses are 20' apart.


My bad. They had tons of dumb rules, no religious signs or ornaments to be displayed past your front door, no election signs sooner that 5 days prior to election day, no flags can be raised other that US and Texas flag, cant have commercial trucks or equipment on the property past 8pm. The neighborhood is still nice, I think it would have been nice without the over reaching HOA because it was a neighborhood where everyone had $$$$ and took care of their stuff.

You can't make a law take effect retroactively. Assuming you're telling us the whole story, this would never stand up in court. You don't say what the neighborhood was like...housing density, etc. At the very least, there should have been a reasonable length of time to come into compliance even if existing uses weren't grandfathered.

Where were your parents when these rules were being drawn up? This would have had to have been voted on, and approved by a majority (maybe even 2/3) of those affected. There also would likely have been neighborhood meetings to draw up the regulations. If they didn't get involved, then they had no leg to stand on.

I hate to say it, but could your father's business have been one of the reasons the neighbors created this HOA to begin with? Auto repair facilities and residential neighborhoods don't mix well. Again, these regulations don't generally come out of the blue...something usually triggers it.

Don’t try to insult me with your petty attemp of an invalid and extremely inaccurate attempt of translating my words!

The FACTS are in been there done that! Seen the score change in both directions, sat in court with attorneys at my side. Beat them, lost to them. Watched others I knew very well become targets because they didn’t fit in with those in charge. Sat in court when the board owners judge friend went against the facts and ruled in thier favor costing us thousands in appeals just to attain justice!

Truth be known it’s exactly people like you who ruin even the concept of a HOA because you actually try to interperate things and almost always get them way wrong.

Agree with most... so far I have been OK in my HOA for the most part and my neighbors are great.

The HOA dates to 1946 and was set up for horses... miles of interconnecting horse trails lead to huge network of regional parks... maybe 40 miles in length.

It was really the only alternative geographically to be near Mom and have acreage...

Should the situation change I have 3 options... live with it, get on the board or sell.
