One thing I have learned over the years, never say never.

Years ago there was no "zoning" in many areas, then came zoning. Oh good, this or that can "never" take place in this part of the area because zoning will not allow it. Then came along "zoning variances" and there goes the neighborhood. Urban sprawl into agricultural farmland. :mad: Money talks!

And don't even get me started on immanent domain!

We have zoning and you can get waivers for $$$$$ . But we also have storm water management , school impact fees , reforestation fees , permit review fees , permit fees , inspection fees , utility hook up fees environmental fees and the rain tax in Anne arundel Maryland . A lot , 1/4 acre with water and sewer at the road is $150K . Finished house $450K . But this property wouldnt perk except for 1 area . And there was no skin on the bone for 1 house . Site work to develope a 4 lot parcel with all the fees runs a bit over $100K per lot .

We've done a few commercial projects in Anne Arundel County, permit costs are no joke either.

I have been taking this very slow.
Won the battle of keeping the gate closed and locked with the easement user. But that can and will be a issue with all the BNB guests.
Seems like we both agree that a electric gate control with a pass code would be needed. Somehow he feels that that is all me to do.

Next step will be the maintenance.

Sure thing - get an agreement signed. You do the work (or have it done) and he pays for a proper portion for parts AND labor.

^^^Love it... the power of comprehension is often underestimated.

Yep....my ex wife and her attorney learned that lesson too.
I had the language, and she (attorney) did not have the comprehension.
Only saved me a few thousand out of MANY, but it was personal satisfaction.

I know that the principal of it factors in somewhere but is a couple thousand dollar gate or tens possibly hundreds of thousands in legal fees plus a bitter relationship forever a better deal?

The way I see it, if you want it done for your own sanity, it is all on you to do (added cost and labor). Neighbor could tell you to take a hike.

Mighty Mule Gate operator with battery, solar charger, keypad/pedestal outside for entry and proximity pad inside for exit will probably come real close to $1,000.00, maybe a bit less if you shop around. They can be programmed to close automatically after 'X' time.

Gate and posts if you want to replace/upgrade could be another $500.00 or so.

Labor could be free if you want to install it all yourself. MM operators can have some maintenance headaches though.

Read the reviews before buying a Mighty Mule. They are the cheapest choice out there and a lot of people are not happy with them. If a lot of people will be using the gate, then it will wear out faster then expected. Everything about them is light duty.

Mine may not be leveled exactly right, but when the air temperature gets below about 20 degrees, it won't open fully. In my case, I rarely have to go through it in very cold weather.

Light duty is the truth. They make heavier versions, but at much higher costs.

I have had 4... one came with the property and two purchased by me and one warranty.

They worked fine until forced...

The gate has a lot of leverage and the Mule is the weak link.

When the last Mule tenant moved out I removed the unit before the new renter moved in...

It would be great to have a heavy duty opener for me but too much trouble with tenants and being 800 miles away.

And THIS is exactly why when you're looking at buying property and see any term related to the word EASEMENT in the sale, you run the other way.

Not what you want to hear apologies.

No different IMO than when you hear "Home owners association" when you're looking at a home.

The reality is no one here can give you legal advise to the issue you have at hand on your property over the internet. You need a lawyer in your state, and wish you the best of luck.

Worst case, shoot guns at all times of the day and night to get the people who rent the cabin to complain to the owners. Perhaps they'll pay a pretty penny for your property so you can move, or you can just become redneck Billy Bob for a year to decrease the value of the cabin up the road:thumbsup: Nothing like seeing a guy in his tighty whitey's walking down the gravel road scratching his nuts with a beer in his hand and a shotgun slung over the shoulder to persuade some city folk to leave pretty quickly:D

Just play a banjo loud n proud....maybe squeal a little in between....LOL
