It doesn't help that most people cannot speak, write, or comprehend plain, common English, let alone legal jargon. I laugh when I listen to foreign people speak correct English. They have it correct. We don't. :laughing:

Case law is an interpretation of many phrases, terms and language by courts over a long period of time. If you were to try and include a “plain language” interpretation along with every statute and change to a statute I think you may wind up with more litigation and not less.

Just as the legislative system is designed to kill legislation the civil court system is designed to encourage cases to settle instead of being tried to a verdict. What encourages those cases to settle instead of being tried to verdict is a generally accepted understanding of the interpretation and application of many of those terms, phrases and language built over time.

Yes some lawyers do fleece the general public. But “plain language” won’t prevent that. You are better off to try to reduce the litigiousness of individuals who can’t seem to resist the allure of being successful plaintiffs, no matter how fleeting that success may be.

I wasn't even referring in terms of litigation as much as simple legal documents of civil matters and alike. And I and others do feel fleeced anytime we are required to have any attorney draw up or explain simple legal documents that very well could have been written in simple language that the majority of the general public readily understands.

You seem offended by my explanation for some reason and that was not my intent.

There is nothing wrong with a simple explaination letter accompanying a legal document. Done all the time. That is very different from what you said in post #221.

As far as the thread being sidetracked, an HOA and an easement involve legal documents. Problems often arise from poor drafting of those documents.

It appears some residents have nothing better to do than look for reasons to report neighbors for violating the rules and regulations, whether real or imaginary.

Just one more reason I would never live within the confines of a H.O.A.
